Truly disgraceful, indeed. Pointless and actively harmful to police action. An endless succession of incomplete surrenders to the far right, who then just pocket the concession and demand more.

This is costing every country that does it *massive* amounts of money. Half the Bundespolizei in Germany have been withdrawn from places where they can do genuinely useful crime-fighting and deterrence work such as main railway stations and are being housed and fed at great expense at the border.

It's inevitable that these German cases will end up at the ECJ, and when it rules against them the whole sham will collapse as the ruling will apply to the whole of Schengen. But they'll fight it all the way. European unity: yet another area in which Germany does not practice what it preaches.

sorry for the logorrhea, but it's worth noting that the Bundespolizei in Germany was the Bundesgrenzschutz until 2005, when it was reorganised and redeployed as a more general federal police force precisely because most of its border control functions were no longer needed. Yet now..

I actually considered starting a ECI on this exact issue but nobody else seemed very interested probably because the mechanism for ECIs seems to be designed to minimise the risk of the Commission having to take any actual action whatsoever.

because the most obvious thing about these controls is that if they're justified as necessary to deal with exceptional circumstances, after a few years those circumstances are now routine, not exceptional, and dealing with them should be a part of day to day policing, not via an exception mechanism.
