In 2024, when the Supreme Court gave presidents immunity, the line here was that no office should be a shield. Federal agents searched Ilhan Omar's home today over immigration paperwork her late father filed when she was a child. The principle doesn't change with the party.

Concede the obvious: three weeks before her election, with officials prejudging her on TV, is a terrible way to run a case. And she was a child, so criminal blame isn't hers. But citizenship is a constitutional requirement for her seat, and civil denaturalization has no clock.

Argentina shows where the other road goes. Legislators there have fueros (immunity from arrest), and the Senate never voted to lift Cristina Kirchner's despite a judge's repeated requests. A seat became a shield. Investigate. Then unseal the affidavit.

Then there's Carlos Menem. In 2018, an appeals court confirmed his 4.5-year sentence for secret salary bonuses paid during his presidency. His Senate fueros meant he never served it. He died a sitting senator in 2021. The seat didn't stop the conviction. It stopped the consequence.
