reading Richard Epstein update: kill me now someone please (this one short enough that I actually managed to get alt text in for once)

Entire chapters of this book are just irrelevant ramble. Chapter 6, in particular, is just a rant against the Warren Court that does not discuss a single ruling or piece of evidence about citizenship at all and reads like he just stuck in a separate essay that had been rejected by the journals

We've reached the point that I want to go pull up Epstein's cv and make sure he really has a law degree because he appears to have no capacity to distinguish between relevant and irrelevant sources of authority or even which premises relate to his conclusions

In which we are told that white children of non-naturalized immigrants at the turn of the century should have gotten citizenship-linked inheritance rights basically because of common law equity doctrines but the Asian ones were right out

pg. 172: "If the Fourteenth Amendment conferred citizenship on children of aliens, why and how did that Amendment, in silence, confer citizenship on children?" IN SILENCE??????? IN SILENCE???? The man is on drugs. He has to be on drugs.

At various points in this book he also claims that the 14th amendment has "explicit reference" to the naturalization acts. (e.g. page 10). Perhaps he is illiterate? He reads the text to not confer citizenship on children (when it has an explicit birth criterion) but to have a nonexistent reference.

maybe we should watch him sound out the words and see where he thinks the reference to the naturalization acts is

This is the guy who insisted only 500 people would die of COVID, revised that to 2k only after we flew past his original number, and was relentless in publicly insulting every professional epidemiologist or virologist who dared disagree with him? And never apologized? Same guy? 1/2

...I'm still waiting for him to admit he was wrong about an epidemic that killed millions. We still have more than his final estimate dying of COVID *every six weeks* in the US in 2026. He still pretends he's infallible on every topic.

you know i've sorta watched this thread trundle along and i was thinking you were reading a book by the more well-known epstein and man i'm back to being not sure about that
