i think we've been shown time and again that companies cannot be trusted to act with respect for user's privacy, and that regulation, enforcement, and punitive fines are the only way to get corporations to behave.

I always want to know the NAME of who decided "No, make it opt out, otherwise we'll never get that juicy data", but corporations exist to obfuscate liability
