It’s now been two decades since congress passed the MCA. Soon we’ll celebrate that anniversary for Holder’s attempt to prosecute these guys in an Article III court. I’m not the first one to say it, but the commissions + prosecutors at Guantánamo itself don’t want to actually try these cases.
