Both are illegal because they were not authorized by the Congress under Article 4 of the Constitution. Both violate the criminal statute called the Anti-Deficiency Act because they are involving the spending of taxpayer dollars unauthorized by Congress.

Still, the @nytimes.com, @washingtonpost.com, @wsj.com, @apnews.com have not reported it as crimes. Pure and simple. No shades of grey. -R
