How is it that we've gotten so far from such a basic concept that we have to go to court to argue that it is a bad idea to tunnel oil under a body of water that supplies food and nourishment to people?

Smart people have come up with this idea. It reminds me of the time that the Army Corps of Engineers decided to dam the Missouri River and flooded out an entire village of Native American people in South Dakota.
