The National Guard should always remain under command/control of the states unless there is a declaration of war by Congress.

Question: how do you keep politics out of the military if the military are issued illegal orders? The issuing of illegal orders is itself a political act. As is responding to illegal orders - by either complying with or refusing to follow illegal orders, the choice is political.
