There's a video game coming out which used generative AI to make assets but is also "protected by Denuvo" which is just such a perfect encapsulation of how intellectual property law works and who it is for

Anything AI generated cannot be legally copyrighted and thus would be considered public domain. So games using AI generated art shouldn't be able to change money, let alone use DRM.

I don't understand this recurring claim because transformative works based on public domain works are created all the time. Steamboat Willie is in the public domain but "Screamboat" (2025) is not. Similarly AI generated assets within a video game are probs not copyrightable but the game surely is

In fact, I am pretty sure that you could take an entirely public domain work and protect it with the DMCA, because the DMCA is framed as being about circumvention mechanisms rather then the work itself. The law doesn't care what the protected item is. Because intellectual property law is broken

The DMCA specifically outlaws any enforcement attempt if you do not have a good faith belief that you own the work and that it is being infringed. If you send a takedown notice for a Shakespeare sonnet you can be sued for significant damages

It's possible you know something I don't, as I haven't checked the text recently. But I'm talking about the anti circumvention measures provision of the DMCA and you seem to be talking about the takedown notice provision. The DMCA is an amalgam of different provisions. Part of it is about boat keels

Can you clarify whether you believe this is a conversation about the DMCA takedown notice provision or the DMCA DRM circumvention mechanism provision
