I hear you. But the core question before the Court was: “Can Trump’s executive order stand?” The answer was no, by a 6–3 vote. Justice Kavanaugh joined the majority in striking down the executive order. Suits me. Anything else is pure speculation.

It’s purely speculative what he would have said in a different case not tied to a specific executive order. In this instance, Kavanaugh relied on a separation-of-powers and institutional authority rationale rather than rejecting the Constitution itself, in my view.

He literally didn't join the other 5 on saying it was against the Constitution when it very explicitly is. It's not even a question. And when you have 3 Justices saying it is perfectly Constitutional and fine, that matters. He made a very deliberate decision here to separate himself.

This is Mr. Kavanaugh Stop and you are trying to go out of your way to manufacture a benefit of the doubt when he's already shown the kind of Judge that he is -- people of color just don't have the same rights to him (or the rest of the conservatives on the court for that matter).

He made a decision to set himself apart from all the other 8 justices. If he really is the justice you think he is, then he could have just gone along with the other 3. I wonder why we’re talking about him so enthusiastically here instead of the other assholes who voted against the Constitution.
