The minority opinion is some of the biggest garbage I have ever seen. It simply ignores that the DOJ chose to wait for months, until votes were being counted, to file this action.

Unlikely on the former, probably on the latter but also unlikely for SCOTUS to grant *cert*. More generally, appeals from here are up to the courts to decide if they care, and they can quietly punt it and they're almost certainly going to do so.

At what point do these attempts to disenfranchise voters become characterized as a crime? Seriously... enough already.

The tell is Bennett. A judge Trump himself appointed looked at DOJ's faulty list and still voted to throw the case out. When your voter purge cannot survive your own side's judge, the list was never the problem. The intent was.

Cuz that one guy is HARD right zombie level. The scariest thing about these cases is they just need one win to punch a big hole in democracy that will wreak immense havoc for a very long time. It’s scary af.

Absolutely astonishing to see the first openly gay Filipino judge be such a sell out to the government pulling illegal/unconstitutional shit. Not the legacy I'd ever want. Traitorous... Lifetime appointment, too. 😏

The context here is that DoJ appealed a denial of a TRO before the district judge had even denied their request. Or, more precisely, they appealed the date he set for a hearing -- which isn't appealable. Whole thing was fucking absurd.

Dear Judge Bumatay: see Nevada. These DOJ stunts are just nuisance fishing expeditions to try to foster even more electoral distrust among Trump’s base and hopefully make them decide to go vote.

9th Circuit dismissed this 'emergency appeal' only. This case goes back to the trial court for a TRO hearing on the merits tomorrow, 10/27, which DOJ will likely lose. 🙏🙏🙏🙏

So two of the judges know they lack jurisdiction but the Trumpf apologist can't help but try to aid and abet........
