The CLARITY Act passed the House in July 2025, with 78 Dems voting Yea. The legislation hands “exclusive jurisdiction” over so-called “digital commodity” spot markets to the CFTC — a smaller regulator with a history of being friendlier to the industries it nominally polices than the SEC.
