In this instance, the executive order is merely the instrument; the claimed legal authority is the waiver authorized under Section 115 of the Lindsey O. Graham Sanctioning Russia and Iran Act of 2026.

Whose national interest is this serving?! "I have submitted to ‌the Congress a certification that the issuance of such a waiver at this time is in the national interests of the United ‌States," - Trump

Sadly, Congress expressly authorized waivers. Section 115 says the president may waive any covered sanctions provision, restriction, or duty. It requires a written national-interest certification and a report explaining its basis to be submitted to Congress before the waiver is issued.

It would be interesting to review the actual congressional submission to see whether it adequately explains the national-interest determination. But with this rubber-stamp Congress, adequacy is probably irrelevant. They will rubber-stamp the waiver.

Why now? Why not wait until post election as for anti-abortion and -healthcare? Why does he need to deliver this to Putin pre-election?

The receipts here are concrete: a presidential order exempting Russia from sanctions legislation is the policy shift itself, not a rumor. The fact to press is that Congress wrote those sanctions into law, so an exemption by executive order means the law is being bypassed, not merely interpreted.
