⚖️ Almost two years since the #ICJ concluded states should "prevent trade and investments" sustaining Israel's illegal occupation. the EU has still not acted. This despite its own treaties requiring compliance with international law in its external actions. 2/5🧵

📢 The Commission still claims a settlement trade ban would need unanimity as a sanction. But the Council's own legal services disagree, confirming it's a trade measure instead. Former trade commissioners, ministers, and legal scholars back this view. 3/5🧵

📝CIDSE & EuMEP proposal sets out a fully-developed EU Regulation under Article 207 TFEU to end trade with illegal Israeli settlements, addressing everything from rules of origin to enforcement. What's needed now is the decision to act. 2/2 🧵

4/5 The proposal is based on extensive legal and technical research conducted jointly by EuMEP and CIDSE, with input from European trade and constitutional lawyers, EU specialised law firms, customs experts, and former and current EC officials 🧵

2/5 It's grounded in the EU’s obligations under international law, in particular the 2024 ICJ advisory opinion, which requires states to prevent trade that sustains Israel's illegal situation in the occupied Palestinian territory, built on extensive legal, technical and consultative research. 🧵

3/5 it proposes a trade measure under the common commercial policy (Art 207 TFEU) that would align the EU’s trade policy with international law. 🧵
