One of my biggest disappointments in American discourse over the past decade has been the mainstream media. With very few exceptions, they have failed the American people miserably.

#immigration This has been bothering several of us for some time. Where is the nationwide injunction? Where is the lawsuit requesting an injunction? So many orgs: ACLU, Amica, CLINIC, RAICES, + private bar w/ arrests ongoing since last month, plntfs w/ standing & nothing?!🤯

Indictment against Abrego Garcia. Re-hashing old allegations (that were previously rebutted)…but ok. Reminder: crim evidentiary burden is ‘beyond reasonable doubt’. Previous evidence of MS 13 involvement insufficient at ‘totality of circumstances’ but…🤷‍♀️ www.documentcloud.org/documents/25...

SCOTUS told them they needed to bring him back b/c he was improperly removed. Instead of admitting fault, they are now accusing him of crim activity to save face. Let’s see the charging document. He’s supposedly so bad, so where is it?

BREAKING: Chief Judge James Boasberg finds that those people sent to CECOT under the Alien Enemies Act on March 15-16 had their due process rights violates and certifies them as a class. He orders that the government "facilitate" the ability for them to seek habeas relief.

Senate GOP are lying. Full stop. Not “misinformation”. Not “misleading”. It is a lie. Knowing, intentional, from Senators who are aware of the law. Undocumented *do not* receive benefits. At all. Of any kind. State or Fed. No Medicare. No Medicaid. No disability. No SS. No food assistance. Nada.

“When asked whether the arrests could deter people from showing up to court, Mr. Ripa said it was not clear.” Absolute BS. Arresting ppl like this *absolutely* deters them. In absentias have skyrocketed nationwide, since these began. Either Ripa is lying or is an idiot. Or both.

So, so , so many factual inaccuracies in this article. …ok, just straight lying. www.nytimes.com/2025/05/30/u...

“I think it’s really just in the initiative stage,” he said. “So I don’t have any concrete evidence to show one way or the other.” There’s this little thing called the docket. Info like no. of in absentias orders can be viewed/compared b/twn days….

Major change in data after 5/21-like, say, in absentia orders rising exponentially compared to prior weeks/months-is good “evidence” of causation. But…guess we’re focusing on the word “concrete” then? 😑

“A senior ICE official said in a statement that the agency’s prosecutors still had discretion to dismiss cases.” Massive lie. Only way to say no is if you don’t mind getting disciplined, potentially fired. Lawyers *will* dismiss cases HQ ordered. Lawyers *cannot* choose which cases

Marginal propensities. Let’s talk about ‘em. Economists deal with two: marginal propensity to consume (MPC) and marginal propensity to save (MPS). IOW, if I give you a dollar, how much do you spend, and how much do you keep?

It’s a conspiracy to screw the poors and, as usual, the veteran fraudster says it’s free. Call your Senators and tell them if they attack you and your family like this, they will lose their job, their insider trading racket, and their ability to live without doing real work. (202) 224-3121

Lots of confusion (understandably so). Basically, ER expanded in new memo from 1/23/25. Expanded to include entrants w/in last 2 yrs, & w/o visa or other lawful documents or who entered w/o inspection.

#immigration West coast/Pacific time non-detained masters: arrests are going to start at non-detained masters, to process under new expanded ER. Starting today. Attorneys/non profits, please be advised.

This was *only* happening at immigration courts. Might be happening elsewhere, but post was about this specific new development. Does not apply to ppl outside these guidelines. But these are *very* broad new guidelines. 1/23/25 memo attached below.

This is the leadership of this admin. There are great #federalemployees who are career civil servants. They are being forced out by leadership who has a temper tantrum & then risks an entire US agency payroll (re:taxpayer money).

Be kind to federal employees. Many of us are loosing our jobs. Some over text message. Some are keeping jobs, but it’s getting harder and harder to deal w/the narcissism & incompetency at the top. We love your kindness. Hopefully, we’ll all get through this together. 💕

No thought how that would affect pay period. No thought how that would affect schedules for those who use AWS w/families. Who already have future plans/appointments/etc scheduled. Nope.

DHS Fantastique Plastique got the mad fee fees on a Friday and *over the weekend-ie not work hours* forced meetings & messaging to clean her mess. Any use of AWS could lead to termination.

Last week, DHS Dress-Up Barbie got upset that so many employees were not at work, on their off Friday. So that Sunday, DHS wide email informs agency that AWS is gone immediately. Mid pay period.

Not going into this decision. It’ scary given what precipitated the decision. To truly understand, read Sotomayor and Ketanji-Brown’s dissents. To compare something to Korematsu is extreme. But Sotomayor is reasoned, intelligent, nuanced. Her comparison is apt & that much more frightening.

#BREAKING: 5-4 Court, with Barrett joining the three Dem. appointees in dissent *vacates* Chief Judge Boasberg’s temporary restraining orders in the Alien Enemy Act cases. Judicial review must be available, Court holds, but has to come through habeas petitions: www.supremecourt.gov/opinions/24p...

He had his day in court several years ago. An IJ found he had met his legal burden sufficient for withholding of removal. Did not grant asylum, but still granted a form of relief that would prevent removal to a specific country.

Now, yrs later, he’s arrested, & removed to a country in which an IJ specifically found he faces a more likely than not chance of being persecuted, a violation of prior WHO order. Very bad.

This means they *legally cannot be returned*. This is called refoulement. US cannot return a person who has been deemed a refugee to a country in which they may suffer persecution. INA 208 (asylum) INA 241 (WHO). But see Matter AEM finding WFF rebutted.

So what does this mean? It means that this individual, arguably, has a very solid claim to get the US to bring him back to the US and, once back, has a very solid civil claim as well. A lot went wrong here.

Second: he was granted withholding of removal under INA 241. That is not a discretionary finding. That is a finding in which an IJ finds a person has shown, by a preponderance of the evidence (more likely than not) that they have a well founded fear of persecution.

That is why a non citizen is given a charging document called a notice to appear (NTA) & why the court proceeding *must* be in a language they understand (the court is resp for providing an interpreter in a language they understand) & why they *must* be read a list of rights & advisals.

It’s called due process. Everyone has a right to due process. Any *competent* attorney knows this. The levels, or strictures of due process may vary (especially between civil & criminal) but everyone has a right to due process.

Literally no one gets a jury trial in immigration proceedings. Immigration court does not have juries. Ever. Never did. Ever. It is a bench trial. Immigration court is civil and has never, ever had juries. Ever. That’s not new & is the most basic immigration 101.

All individuals in the US have a right, per the 5th amendment, to due process. (Fun fact, juries aren’t mentioned in that amendment so, again, very basic mistakes and misinformation). That includes citizens as well as non-citizens. Everyone.

The non-citizen *was not* found to be a member of MS. There was info that he *may* be. But it was conjecture. Thats something an IJ reviews & things like crim (or lack thereof) r factors that can go toward decisions. So, no. He was never determined to *actually* be a member of MS.

*note: non criminal traffic violations are not big deciding factors. Especially when trying to determine whether someone actually is a member of MS. So saying someone has traffic violations tells me…they don’t actually have crim & the writer knows this & is purposefully trying to mislead. 🤬

To start, simply: immigration judges (IJs) are not appointed. They are not political appointees. They are not confirmed by the Senate. They fill out a job application, submit their resume, & are interviewed by IJ leadership (ACIJs, etc).

IJs are employees. They are administrative law judges, like the social security hearings officer or any other ALJ in a federal admin agency. They are DOJ employees. So…not sure how who was president (who wasn’t president at the time) is in any way relevant. 🫠
