On 17 October I was at Place de la République. The police fired tear gas and stun grenades in astonishing quantities. Most of the people around me were school pupils. I spoke to @verfassungsblog.de about that night and what international law says about policing minors 🧵

As a German-French lawyer, I keep asking why protest policing differs so much across the Rhine. Since Brokdorf (1985), the German state must make assemblies possible. In France, protest is still treated as a threat to order, and pupils now feel what the banlieues have long known.

1/ The ICC removed its Prosecutor for sexual misconduct. This December it elects six new judges — through a vetting process that couldn't do the one thing it exists to do: confirm the "high moral character" the Rome Statute requires. 🧵

2/ The report that would answer the question exists. The states who cast the ballot won't see it. So the only warning that reaches the vote is the one that always has — people quietly warning each other. It shields a few. It stops no one.
