Soo... now the DOJ's stance is that that the president's execs are not something that agencies will necessary follow?

Disappointed that NPS Deputy Director of Operations Frank Lands wasn't grilled today, but we feel confident we will get to hear Frank's testimony in many future hearings as the DOI and their minions at NPS begin to be held accountable.

J: what is dept's position. is there a final plan, as Pres Trump has said, or not. DOJ: agency's position is, there's no final plan. J: what about Trump's statement that he and Dept of Interior Secy Burgum are excited about plan to build Fazio plan. is there a US contract with Fazio? /171

DOJ: even if court disagrees with us on standing or final agency action, when you get to end of road, there's no there there. the NEPA claim fails under slightest scrutiny. J: let's go back to final agency action. Have POTUS saying there's a final plan. Have you all telling me: no final plan. /170

Govt has claimed changes were only about executing a 2019 plan. ... but now Trump says his new plan is starting immediately. strong showing of bad faith. govt argues i'm violating fundamental separation of powers principles. says i can't compel testimony of high-level officials. /11

At 10am Judge Ana Reyes will begin an evidentiary hearing in the golf course case at 10am. I'll try to live-blog from the US Courthouse media room for @lawfaremedia.org . This is a case to stop Trump from converting a historic public golf course, open to all, to a Trump style championship course.
