Who up for surrounding parliament with trans people? If they have to walk past us they have to look at us. Make them feel uncomfortable.

Ok if you want to protest the reported drop of the EHRC’s blue print to shit on trans people get in contact with us. We want to do something fast and visible, very visible.

Call to action. Given reports the government is to drop its transphobic guidance from the EHRC today it’s time for us to get back to the streets. Who’s up for a second protest? We are looking to protest again and use the very guidance against them, show them it’s unworkable and stupid.

If you want to get involved protests to be planned in multiple locations simultaneously, north a south of the border. Time is of the essence here so potentially looking as early as next week. DM for information. We are keeping this one quiet to stop it getting targeted be anti trans groups.

In light of the person coming forward who claims to be at the centre of the M&S issue saying her management are supportive we have chosen to pause the booking campaign. Hopefully M&S this as person claims nationally and not just locally. We shall see. In the meantime don’t book anymore please.

ECHR: Christine Goodwin v UK (1) (2002) App no. 28957/95. Facts: Post-op trans woman denied recognition for marriage, pensions, privacy. Held: Violations of Arts 8 & 12 ECHR. UK obliged to give full legal recognition to acquired gender. Led to GRA’s “for all purposes” wording. 14/44

Now we looked at case law including pre GRA to see the direction the courts were taking historically. 10/44

UKHL: A v Chief Constable (1) [2004] UKHL 21. Facts: Post-op trans woman refused police constable job involving female detainee searches. Held: Unlawful sex discrimination under Sex Discrimination Act 1975. “Woman” included post-op trans woman absent exclusion. High bar for implied exclusion. 11/44

EA 2010 Provisions Schedules 3, 9, etc.: allow single-sex services, separate services, and restrictions in sport and charities based on “sex” in s.11 and s.212. 8/44

Legislative Interaction Two readings: Override reading: EA’s “male/female” is biological, s.9(3) GRA triggered. Consistency reading: EA’s “male/female” is legal sex; no express override. 9/44

EA 2010 Definitions (1) Section 11: “Man” means male of any age. “Woman” means female of any age. Section 212 repeats these. No mention of GRC or legal sex. 6/44
