Whether it's Gavin Newsom or Donald Trump, the surest sign that someone is unfit for high elected office is their willingness to file defamation lawsuits once they are in it. Never vote for people like that.

You might possibly have a point if the message was "vote for Donald Trump because he's no worse than Gavin Newsom." But the message was actually (and rather clearly, if one can read) "don't vote for anyone who does shit like that, regardless of what party you belong to."

If you slide the word "frivolous" in there, I agree, which still covers Trump and Newsom. But there is such a thing as a legitimate, justified defamation lawsuit and I ain't gonna be mad about filing one if there's actual defamation going on.

I think the voting machine cases were good cases to bring. Bringing one as an elected is very sketchy. But my line on this is not as sharp as it used to be because the norms of serious publishers have dropped. (My background is amateur, having learned 1A law as the editor of a college paper.)

The voting machine cases were brought by private parties and poll workers! So not really within the scope of this. And I also want to account for perhaps lower-level electeds where the balance is slightly different, which is the reasoning behind "high office" in the post.

Ah, I had missed the news about the orange one's suit. Fair enough, I can't imagine I'd ever support a suit from a president. My feelings about other officials, even governors, though has really shifted. It's not clear democracy can survive a marketplace of ideas that is this dysfunctional.

Apparently pointing out that thin-skinned, frivolous, and abusive defamation litigation from elected officials is bad from anyone is "both sidesing." I prefer to call it "principle" but 🤷‍♂️

Maybe people don’t accept the premise that Newsom’s suit fits that description…? It’s political, sure, but don’t act like Trump’s strategy of suing everything that moves - law nothwithstanding - is the same as Newsom challenging Fox News’ constant lies.

in fact, it IS exactly what a courtroom is for- if there's lack of good statutes or caselaw on this particular point, in the jurisdiction in which Newsome filed, then a case like this triggers a response (eventually). the parties here can afford to hash it out - there's no punching down here.

and if Newsom's case gets shitcanned in a way that blocks similar type cases (not just cases filed by Dems/liberals) from being viable (like being subject to fee shifting), then that's a good (eventual) result. right? ivory tower v. long term strategy hasn't been working out for the ivory tower.

I agree that Newsom’s suit is frivolous, but I think he’s doing it to prove a point, not because he’s like Trump. He’s showing everyone how frivolous Trump’s suits are. That’s how I read it at least.

Au contraire, Ari. Gavin Newsom didn't start this bullshit, and he put up with it for a very long time before punching back. Want Democrats to stop looking weak and feckless? Then they need to stop being weak and feckless.
