1. I have fully read and reported on the SCOTUS anti-trans BPJ ruling today. The decision is very bad, though not as bad as the worst case scenarios. It will still likely lead to mass discrimination in both red and blue states against trans people. Subscribe to support our journalism.

Since this ruling is dictating the very definition of "biological sex" in Title IX, isn't the Supreme Court offering states the option to overlook sexual harassment/assault reports from transgender people - or even transfeminine people specifically?

Will there be coverage of the implications of this ruling on the Equal Protection Clause of the 14th Amendment? A lot of the ruling and dissent focus on this aspect of the cases, especially considering it was the only concern in Hecox.

They did not rule on equal protection broadly. Instead they said intermediate scrutiny applied but that even under intermediate scrutiny this challenge failed.

True, yet a lot of the reasoning for why it would fail intermediate scrutiny would apply to most other trans issues that involve segregated spaces like bathrooms. It’s the first thing clarifying trans people’s position within that legal framework and it’s a bad one.

Yeah, I do find the collapsing of intermediate scrutiny a major issue. Depending on how that gets read by other courts, it could have impacts far, far beyond trans people.

“Catholics represent 19–20% of U.S. adults. The probability of randomly selecting 6 Catholics from a population that is 20% Catholic is 1 in 15,625. That is the mathematical answer to the claim that religion played no role in Leo’s selection process.” @njm4.bsky.social medium.com/@peterpandus...

Being trans is part of "biological sex". The extremist right-wingers call their binaristic view about biology "biological". But their view about biology is called gender, the social construct of putting people into boxes based on pseudoscientific ideas. Sex isn't a binary.

Why is it anti-trans?? Does it mean they get whatever they want because they now wear a dress no matter who it hurts?? What about a woman's right to compete against women in their own sport?? Why should women get their rights stripped away?? Why can't trans compete against men?? Thank U scotus!!

2. On June 30—the last day of the term and the final day of Pride Month—the Supreme Court issued a 6-3 ruling that states may ban transgender athletes from women's and girls' sports, holding that Title IX permits schools to determine eligibility based on “biological sex.”

3. The ruling, authored by Justice Kavanaugh, was narrower than some of the worst-case scenarios: it preserved Bostock, did not overtly strip transgender people of equal protection, and explicitly declined to decide whether states must exclude trans athletes.

4. But its most consequential holding still has vast consequences. The Court declared that "sex" in Title IX "cannot plausibly be interpreted to refer to anything other than biological sex"—a definitional ruling about the statute itself, not merely about sports.

I spent what little career I had stridently arguing for an aggressive and affirmative definition of sex because I knew that Title IX protection was paramount. And it has come to this, in an argument before the court that I can only call "grovelling".

5. And though the majority avoided saying that blue states must discriminate against trans people under Title IX, its holding leaves wide lanes for the Trump administration to pressure schools and colleges through funding threats and investigations, and for far-right organizations like the ADF.

smth i noticed about the dissent bsky.app/profile/goog...

J Sotomayor in the dissent makes this point about "no one disputes MALES have an inherent advantage" several times. its gross to see this in the liberal dissent. the dissent explains that the court didnt consider "the science and facts" when it comes to trans girls who have NOT undergone....

America, Russia, Britain, India; Democracy, Oligarchy Autocracy, liberal or conservative, it matters not the flock, the cissexual will always seek to stamp out our kind. We must focus now on the construction of mutual aid networks and secure a future for our race no matter the oppressors' intent.

I really hate saying this, but this is just another step on the road of transgender genocide in the US. :( Where the fascists go from here is only going to be worse for trans people all across the US.

The focus on sports was always a fools errand. Boys even before puberty in large are stronger than girls. Are we really going to be testing children as they get older to make sure they are taking their medicine? Are we going to have schools going over records of when you started transitioning?
