Did the victim's family play this in hopes that the killer would get a shorter sentence because they wanted to forgive him? If so, it seems to have backfired spectacularly since the judge imposed the maximum. Or maybe that was what they were after? So confusing.

At any rate, the appellate court is absolutely correct to call foul, throw out the sentence, and start over.
