We’ve officially moved from "the rule of law" to "the rule of the DM." It turns out the highest court in the land is adopting the same operational transparency as a corporate HR department during a mass layoff.

The danger is not only the outcomes. With compressed briefing and little reasoning, lower courts, lawyers and the public lose the guidance needed to challenge or consistently apply them.

Congress needs to employ the appropriate tools. Impeach Thomas immediately for lying about the bribes he received. Then prepare to impeach Alito and Roberts for financial impropriety, and Kavanaugh for false testimony. Legislate enlargement of the Court and rigorous ethics rules with penalties.

The Supreme Court has done a disservice to the American people and the rule of law by not fulfilling their duties and hearing the cases submitted to them in public for all to see, instead of behind closed doors without deliberation.

The other problem is that shadow docket decisions have no precedential value. That means the Court can greenlight actions by Trump without having any legal obligation to extend the same deference to the same actions by a future Democratic president.

A disservice to the lower courts and federal courts that have to guess what the basis of a decision was when ruling on future cases. Will only lead to more embarrassing situations of overruled decisions and questionable appeals. A farcical court system of second guessing.
