The baseline is that current IP law (esp. trade secret and copyright) broadly allow reverse engineering. It promotes the Progress of Science and useful Arts to let people study how things work. Although it helps people make competing products, most branches of IP are okay with this.

We discuss four options, (1) Do nothing and let the reverse engineers run free. (2) Tighten IP laws to try to restore the old balance. (3) Loosen IP laws to encourage this creativity. (4) You can do what you want if you own the physical device, but not to other people's devices.

Mostly we're putting this out to encourage the legal and policy communities to think seriously about the tsunami coming for software IP.
