Or, I don’t know, kind of wild idea…. What if we required a particularized warrant, issued by a neutral and detached magistrate upon a showing of probable cause, before giving police access to unprecedented locational surveillance data ?

We need to make it a federal crime for police officers to use surveillance data in any unauthorized fashion. Put a few of these loathsome people away for 20+ years, and I guarantee we’ll see a whole lot less of this behavior.

Some people think that Learned Hand had the perfect name for a judge. But "Learned" was the judge's middle name, not his first name. Hand's real first name was better suited for a lawyer: Billings.

A thing that has bothered me since LAW SCHOOL: Filburn was also growing wheat for the market. At issue was the part he planted over and above his commercial allotment. It was a “marketing” allotment, not a growing allotment .
