Finally read the SEP Capitalism entry. My review: It's reasonably good contemporary political philosophy attached to surprisingly bad intellectual history, with a handful of the same conceptual problems leaking across the border.

I finally read Daniel Kuehn’s paper on Robert Singleton, James Buchanan, and Angela Davis at UCLA. There’s genuinely important archival work here. But I think Kuehn’s evidence is considerably stronger than the interpretation he builds on top of it. 1/

Otherwise there is an important asymmetry: Singleton’s experiences explain his politics, but Buchanan’s experiences merely provide the scenery against which his politics are judged. That isn’t enough if the goal is to understand Buchanan’s constitutionalism rather than prosecute Buchanan. 30/

So my reaction to Kuehn is not “Buchanan is innocent.” It is that Kuehn has found something genuinely troubling about Buchanan, but I’m not convinced he has correctly identified what he found. 31/31

That does NOT excuse Buchanan as contextualization is not exculpation. The question is what those experiences did to his understanding of const. order. Did Buchanan believe institutional protections were being exploited by actors trying to destroy the institution sustaining those protections? 28/

If so, we need to know what followed in JMB's mind: political violence, perceived institutional breakdown, belief that procedures were inadequate, willingness to empower external authorities. That chain may be unjustified, but it has to be reconstructed before we can identify what exactly failed 29/

I think context may be a big missing piece to Kuehn's story. He gives us a serious reconstruction of why Singleton became Singleton: Singleton’s experience of segregation, the Freedom Rides, jail in Mississippi, and civil-rights activism help explain how he understood the Davis controversy. 26/

Kuehn reports Buchanan’s experiences too but does much less to reconstruct Buchanan through them. His dept. had experienced an attempted bombing. Students were murdered on campus. Buchanan had decided to leave UCLA after the bombing attempt. Those experiences potentially matter enormously. 27/

That leads to what I think Kuehn may have discovered: Perhaps Buchanan’s const. liberalism is much less liberal once actors inside an institution are using its rules to threaten the order itself. Then he is receptive to political control, selective punishment, taxpayer sovereignty, and hierarchy 24/

Several possibilities: Buchanan failed to live by his own theory, his theory contains an implicit emergency exception, preservation of const. order occupies a higher place in his liberalism than procedural protections, or there is a genuine contradiction. Those are not the same claim. 25/

But I think they create a different and potentially much stronger internal critique. Buchanan's constitutionalism is supposed to get us away from choosing rules based on whether they help our friends and hurt our enemies in the immediate dispute. Yet Buchanan’s letters are the opposite. 22/

Ask the Buchananite question: Would Buchanan endorse the same general rule if a left-wing Board of Regents used an alleged crime connected to a conservative professor as a “wonderful opportunity” to purge administrators who had supported hiring him? If not, we have a real problem internal to him 23/

Kuehn then notes that “taxpayer citizenship” has historically been racialized and quotes racist/reactionary hate mail to Davis signed by “taxpayers.” But what does that establish about Buchanan’s argument? Without another evidentiary link, very little imo. 20/

None of this defends Buchanan's behavior. He prejudged Davis, tried to exploit the Marin crisis politically, and his private correspondence is intensely personalized and punitive. Those facts should trouble anyone who takes Buchanan’s constitutionalism seriously. 21/

And the contrast between Singleton being denied access to the Regents and Buchanan receiving friendly responses is interesting but weak as evidence of racism. Buchanan was a famous senior economist with elite connections. Singleton was a much younger scholar still completing his doctorate. 18/

Race, status, ideology, networks, seniority, and timing all move simultaneously. I was especially unconvinced by the “taxpayer” discussion. Buchanan invoked taxpayer authority over public universities. 19/

Similarly, saying Davis’s lectures “definitively proved her brilliance” is advocacy language. There is evidence she was an exceptionally popular and impressive lecturer. Say that. A historian shouldn’t turn favorable evidence into metaphysical certainty because the subject is sympathetic. 16/

I also think the racism argument needs greater care. Kuehn gives good reason to believe Singleton sincerely believed racism was the overriding issue in the Davis affair. But Singleton’s sincerity and Singleton’s causal diagnosis are two separate propositions. The first does not prove the second. 17/

There are also places where the narration becomes too prosecutorial for my taste. Example: Kuehn states in the text that the FBI “instigated” the murders of Huggins and Carter, while his own footnote notes that how directly the FBI instigated the murders is disputed. That distinction matters. 15/

There, the courts actually held that the Regents could not constitutionally do what they were trying to do. And Buchanan later said Davis should have been fired. That creates a much sharper problem for Buchanan. 12/

But the paper tends to collapse several distinct events: the 1969 attempted firing for Communist membership, the 1970 nonrenewal of Davis’s contract, and the post-Marin effort to remove university administrators Kuehn himself acknowledges that the nonrenewal stood on firmer legal ground. 13/

The missing institutional question is crucial: What powers did the Regents legally possess? Could they remove Young? Hitch? Change appointment procedures? Reduce funding? Alter university governance prospectively? 10/

If Buchanan was urging officials to exercise powers they lawfully possessed, that can be punitive and illiberal without being an “abrogation of constitutional order.” Kuehn’s strongest case is therefore the original 1969 effort to fire Davis for Communist Party membership. 11/

You can think their preferred constitution was awful, but that's not the same as showing it was nonconstitutional. There is a similar problem with “discretion.” Buchanan argues for less discretionary political power, not literally zero discretion. 8/

Every constitutional order assigns someone discretion within rules. So “Buchanan wanted Regents or legislators to exercise discretion” cannot by itself establish a contradiction in Buchanan’s constitutionalism. 9/

Constitutionalism is not the proposition that whatever rules currently exist should remain unchanged. Buchanan’s constitutional project is about evaluating and choosing rules. A constitutional economist can believe the existing constitution of an institution is terrible and advocate changing it 6/

In fact, Kuehn’s own evidence shows Buchanan and Devletoglou explicitly discussing “long-range changes in the constitutional structure of the university” and looking to legislatures and funding rules as mechanisms for changing it. 7/

So “there’s nothing here” is not a serious response to Kuehn. There is something here. My disagreement is over what exactly Kuehn has shown about Buchanan’s constitutional political economy. 4/

Kuehn’s central move is to contrast Buchanan’s reputation as a theorist of constitutional rules with his willingness at UCLA to circumvent the “existing constitutional order” and embrace discretionary state power. But I think this risks a basic category error. 5/

First, the part Buchanan defenders shouldn’t try to explain away: Buchanan comes out of the episode looking bad. After the Marin County courthouse attack, he appears to have simply assumed Davis’s guilt and immediately tried to use the crisis against her institutional defenders. 2/

And the “wonderful opportunity” letter is genuinely ugly. Buchanan urged Hitch to get rid of Young while separately urging Regent Glenn Campbell to use the Davis affair to get rid of Young, Hitch, and others involved with Davis. That is political maneuvering, not abstract constitutional theory. 3/

I think I would define my work as Augustinian personalist constitutionalism: a politics ordered toward the common good and integral human flourishing, disciplined by the non-ultimacy of politics, the irreducible dignity of persons, and constitutional restraints on fallen human power.

GK was historically the position that ran on general athletic tools and also the one soccer position that crossed American sports. The American GK frequently was a converted multi-sport athlete like Howard. So we had exactly one world-class position and it was the one that needed the base least. 1/

Jake@jakenazar.bsky.social

I have no idea *why* the USMNT suddenly sucks at producing goalies. It doesn't feel like a position that would fall victim to other positions talent drain, you always need goalies. But it's happened for over a decade now and the moment we finally got a #9 we got the worst USMNT goalie ever

Over the last fifteen years elite GL was redefined around the ball-playing sweeper. Neuer first and then the Ederson and Alisson model under the play-out-from-the-back orthodoxy. That is precisely the soccer-specific technical skill the US base does not produce. 2/

The pay-to-play formalization made it worse from the other side, because early single-sport specialization strangled the accidental athlete who used to wander into goal from a basketball court. 3/3
