NEW: Trump's conservative pick to permanently lead the DOJ's environmental division, Adam Gustafson, is already reshaping it. Beyond his alarming record at DOJ on environmental issues, his background includes anti-abortion and anti-LGBTQ+ work. nominationnotes.substack.com/p/trumps-con...

NEW: The Senate will return in two weeks, on November 9, following the midterm elections. Since senators left Washington last month, several developments have shaped how judicial nominations will likely proceed for the remainder of the 119th Congress. nominationnotes.substack.com/p/where-thin...

ICYMI: Trump has nominated Grayson Lambert to serve as a lifetime judge in South Carolina. Like many of Trump’s judicial nominees, Lambert has worked throughout his legal career to restrict reproductive freedom, LGBTQ+ equality, voting rights, and more. nominationnotes.substack.com/p/trump-nomi...

Lambert is a 2012 law school graduate who started in McMaster's office in 2021. He was counsel of record on briefs in Dobbs and Skrmetti on behalf of McMaster and other Republican governors. He's worked to restrict voting rights and defended McMaster's deployment of National Guard troops to DC.

Lambert has been a Federalist Society member since 2013 and lists the Alliance Defending Freedom as an "interest" on his LinkedIn page. I have not yet seen his Senate questionnaire to know whether he was an ADF Blackstone fellow or is otherwise affiliated with that anti-LGBTQ hate group (or others).

No, this is not a young Brett Kavanaugh. This is Trump's previously unannounced nominee for a lifetime federal judgeship in South Carolina.

Per a database of discrimination complaints obtained by @propublica.org , Trump's Department of Education is actively ignoring reports of rape and assault on campuses so they can instead focus on transgender athletes. Their obsession with trans people is actively putting women and girls in danger.

21 judicial nominees are pending. 8 still need a hearing. 6 are eligible for an 11/10 hearing. 2 others likely on 11/18. More nominees could appear at the 11/18 hearing if their paperwork is received TODAY. We'll see if Trump names anyone today for vacancies in Arkansas, NC, SC, and Texas.

No new nominees (yet?), at least on Truth Social. But even if Trump isn't publicly posting them, it's really a matter of whether paperwork is being sent to the Senate. Of course, waiting 28 days to hold a hearing isn't a rule. Grassley could break that norm too in pursuit of confirming more judges.

Love to see this from Judge Araceli Martínez-Olguín, a Biden appointee who was an incredible civil rights lawyer before becoming a judge. She dedicated her career to protecting immigrants' rights and is just the second Latina lifetime judge to ever serve on the Northern District of California.

BREAKING: A federal judge has ordered Homeland Security to NOT conduct election-related field operations that could involve U.S. citizens in California, Connecticut, Georgia, Missouri, Nevada, New York, Pennsylvania, Washington, and Wisconsin

A White House official confirmed to me this evening that Sen. Blackburn has returned her blue slip on Samuel Adkisson’s nomination to the Eastern District of TN. She was previously blocking the White House lawyer’s nomination. And still hasn't said why. nominationnotes.substack.com/p/adkisson-n...

nominationnotes.substack.comAdkisson nomination appears to be moving forward after Senator Blackburn returns blue slipHer decision to initially block his nomination remains unexplained.

UPDATE and further confirmation from a Blackburn spokesperson: “Senator Blackburn has returned a favorable blue slip for Mr. Adkisson. She looks forward to supporting his nomination and ensuring that he is confirmed before the end of the year.”

It will be interesting to see how she introduces Adkisson at his confirmation hearing next month and whether she addresses why she initially blocked his nomination. Or maybe she won’t show up. She’ll likely be governor-elect by then.

I think I'm the first to report this (and I'm still not sure why the White House told me this) but, you know, I'm still figuring out this whole journalism thing.

The counsel of record on SFFA's brief in this case is a young lawyer from South Carolina who was a fellow at the Becket Fund for Religious Liberty. He formerly clerked for Justice Thomas & Judge Sentelle. There's now a judicial vacancy in SC and Madiba's story has convinced me he'll get nominated 🫣

apparently this is 'Madiba Explains How the Conservative Legal Movement Runs on Resegregation Week' altho as I think about it, there may be many such weeks ballsandstrikes.org/scotus/assoc...

There's not much time to confirm more Trump judges this year. But we know Judiciary Republicans will break norms to get as many through as possible. I'm watching today and tomorrow to see if Trump announces more nominees. Several more red-state district court vacancies are open without a nominee.

Nominees whose paperwork is received by tomorrow are eligible for the November 18 hearing. More vacancies exist in AR, NC, SC, & TX. If Cooper and Talarico win their elections, they could block district court nominees in NC and TX next year. I'd think Trump would name nominees for those states now.

During Trump's second term, Senator Collins has voted for 95 percent of his lifetime judicial nominees — many with truly horrible records of restricting abortion access and reproductive freedom.

Susan Collins on Kavanaugh: "I'm very disappointed in his his vote to overturn Roe v. Wade. There was no way for me to anticipate that."

This white supremacist is still appointing lifetime federal judges — and nominated two more just six hours ago.

Trump: "You go up to Minnesota -- number one place in the entire country for the sale of Mercedes-Benz. And Somalians are buying them. They come here with low IQs and no money and they get rich. Do we feel stupid? Our fraud division is getting them all."

Wow.

NEW: Trump named two lifetime judicial picks today. Nebraska nominee Eric Hamilton, a DOJ lawyer, has defended Trump's appalling agenda in court. Indiana nominee Joseph Falvey, a federal prosecutor, is a 2017 law school graduate with a bad record, too. nominationnotes.substack.com/p/trump-anno...

nominationnotes.substack.comTrump announces district court nominees in Nebraska and IndianaTwo more Trump loyalists could soon be lifetime federal judges.

An important note: Trump’s last 18 lifetime judicial nominees have ALL been men — and nearly all are white. He has not nominated a woman to serve as a lifetime judge since he announced Anna St. John's nomination in June. Twenty of the 21 pending lifetime nominees right now are men.

These two nominees will likely appear before the Judiciary Committee on 11/18 — the second expected hearing after the midterms when committee Republicans are planning to break norms to hold consecutive nominations hearings. More nominees announced by Wednesday could be eligible for that hearing.

Trump just announced two new judicial nominees: Eric Hamilton for the District of Nebraska and Joseph Falvey for the Northern District of Indiana. Hamilton is a DOJ lawyer, Trump 1.0 White House lawyer, and was Nebraska solicitor general. Falvey is a prosecutor who graduated law school in 2017.

Two of Trump's nominees played significant roles in cases seeking to limit who can enforce Section 2 of the VRA. One is a Trump judge who's now up for elevation to the 8th Circuit. One is a state solicitor general now up for a district court judgeship. nominationnotes.substack.com/p/how-trumps...

nominationnotes.substack.comHow Trump’s nominees have sought to limit enforcement of the Voting Rights ActTheir separate legal battles challenged two ways private citizens can seek to enforce the VRA.

Trump 1.0 judge Lee Rudofsky, now a nominee to the 8th Circuit, ruled that private citizens can't sue directly under Section 2 of the Voting Rights Act. Then Phil Axt, ND solicitor general and now a district court nominee, argued that citizens can't use Section 1983 to enforce Section 2 either.

Recall also that Missouri judicial nominee Jesus Osete co-authored the Justice Department's brief in Callais. If confirmed, Rudofsky, Axt, and Osete would hold lifetime positions on federal courts within the same circuit, where they could be called upon to decide future disputes over voting rights.

Interesting: Trump judicial nominee Philip Aubart, who played a significant role in the Justice Department’s investigation of former FBI Director James Comey, has never been admitted to practice in the Middle District of North Carolina — where he's been nominated to serve as a lifetime judge.

Aubart was a Blackstone legal fellow at the anti-LGBTQ+ Alliance Defending Freedom in 2013. And he has apparently stayed very involved: His questionnaire says he's captain of his city chapter of Blackstone alumni, and he lists his involvement with the fellowship as 2013—present.

“The Chairman’s plan to hold two back-to-back nomination hearings one week apart without minority consent in November departs from longstanding committee practice and establishes a new precedent that will allow Democrats to process nominees more quickly in a future Democratic administration."

A Grassley spokesperson told Punchbowl there's precedent for the timeline, pointing to a series of hearings in Nov. 2013. But Durbin's staff tells me those hearings were done with minority consent and were "years before massive Republican obstructionism and rule-breaking in judicial confirmations."
