Right-wingers are waging war on Reconstruction. Yesterday’s decision in Trump v. Barbara was a narrow 5-4 victory, but the reactionaries are not going to stop. Shame on some people for serving as foot soldiers for MAGA. My essay for @liberalcurrents.com: www.liberalcurrents.com/the-war-on-r...

liberalcurrents.comThe War on ReconstructionThe Supreme Court's 5-4 ruling on birthright citizenship is just one battle in the right's larger war on the Second Founding.

I think this is the wrong framing. I tell my students that my views are easy to find, but that my views are not what the course is about, as mastering my views is not the same as mastering the material, and that they need a different and broader lens to be excellent lawyers in the relevant space.

Not perfect, but you can make a good argument that this entire unitary executive project is reaction to post-Watergate congressional reforms. This stuff was unfolding as Roberts was coming onto the scene. Those reforms were a mistake and they should never be repeated again.

Trump says the Court's rulings against him are "shockingly bad." But the rulings to worry about are all the ones putting him above the law. @daphnarenan.bsky.social and I are in Slate this morning on the difference between a Court that enforces acts of Congress and one that defies them.

This is sure to be a must read by two great legal historians.

After years of research, Daphna Renan & I are thrilled to announce preorders of SUPREMACY. Why is US democracy so broken? One reason is we've wrongly accepted that 9 justices have the final say over the Constitution. This book traces how that happened—& how we can reclaim power to govern ourselves.

I was about to turn 6 years old on 9/11. I knew something was wrong because of my teachers and parents, but I obviously couldn’t understand the gravity of it.

Rep. Lisa McClain admits that Trump's trade war will "absolutely" cause pain to her constituents, but adds that "at the end of the day I trust that President Trump is not going to do anything to hurt the American people long term"

Notable that circa 1948, segregation *was* consistent with SCOTUS precedent. Truman relied on his own interpretation of the Constitution, rather than deferring to the court.

Guys: Truman’s EO that desegrated the Army was valid b/c: (a) it was an order to an agency; and (b) it was constitutional b/c SEGREGATION WAS INCONSISTENT WITH THE CONSTITUTION.

I mentioned I’ve gotten back into collecting comic books. I got my grail book yesterday. I’ve wanted this since Spider-Man 2 came out in 2004.

Hang on, I was told the MQD would fix these types of abuses of statutory authority!

#BREAKING: By a 5-4 vote (with Chief Justice Roberts joining the three Democratic appointees in dissent), #SCOTUS grants a stay pending appeal in the ballroom case, clearing the way for Trump to continue building the ballroom indefinitely while the litigation proceeds.
