But funding a war is not declaring one or authorizing one. The War Powers Resolution, Section 8(a)(1) (50 U.S.C. 1547), says war authority “shall not be inferred” from any law, “including any provision contained in any appropriation Act,” unless it says so explicitly. In 1999 the DOJ tried this exact move for the Kosovo war, but that was the President’s lawyers, not a court, and no judge ever ratified it. And this year both chambers voted to rebuke the Iran war. You can’t infer Congress approved a war it went on record against. So, funding is not authorization. Appropriation is not a declaration. I feel like some White House reporter needs to ask Trump about the fact that his DOJ has lost 16 straight cases to access state voter rolls and that in 7 of the cases it was before judges he nominated. Oh and point out that I am still not tired of winning.
