1/ On Friday, the DOJ threatened CA election officials with criminal prosecution for counting ballots in compliance with state and federal law. Our Rule of Law Program Director Samantha Trepel, a former DOJ prosecutor, breaks down why the threat is as empty as it is dangerous. 🧵
4/ The DOJ sent LA County a list of 20,000+ people they “reasonably believe are likely” noncitizens. Without explaining its methodology, AFTER ballots were mailed. Officials can't knowingly facilitate a crime based on information they hadn't received.
5/ Even an empty threat comes at a cost: time, resources, and energy. It can also sow doubt and undermine trust in our elections. Threatening the public servants who keep our democracy running is dangerous. www.justsecurity.org/161204/doj-l...

2/ The DOJ sent this threat 17 days before Election Day, and more than two weeks after LA County had already begun mailing ballots. For decades, the DOJ’s own policy was to avoid overt steps that could make an investigation “a factor in the election.” This inverts that.
3/ To charge an official with aiding and abetting, the DOJ must prove they intended to facilitate a crime. Following longstanding state and federal law isn’t criminal intent. It’s adherence to the law.

How are we so confident that someone can only #vote once in an #election?
Regardless of how someone casts a ballot, a record is created showing they voted. If they attempted to vote again, records would flag that discrepancy for election officials.
