(1) The Congressional deadline for States ratification is long past; (2) Five states want to rescind their ratification; (3) It will be challenged and overturned by the Supreme Court because of 1 and 2. Doesn’t mean he can’t do it, but the law.

Yeah, but there is some legal debate if (1) or (2) are even - legal. Can states rescind ratification of an Amendment? They probably cannot once the Amendment is fully ratified. So can they rescind before that? Can Congress even set a deadline on Amendments?

In the end, this SCOTUS would axe it, and probably cite to one of the issues you mentioned because they're opposed to the ERA. Which is why I don't think Dems should do that now. But in a different era, with a SCOTUS that will do a fair analysis, I would want to know the answers to these questions.

There is no Constitutional process by which an amendment has a deadline. In fact the exact opposite is true, in that once approved by Congress they are active in perpetuity until ratified by enough states. There is also no Constitutional deratifying process.

There are many actively proposed amendments awaiting ratification by the necessary number of states, and a bunch of them literally were proposed at the same time as the Bill of Rights. For example the 27th Amendment (the last one passed) was first proposed in 1789

There is also no Constitutional process by which states can rescind their previous ratification. Once a state ratifies an amendment, that’s it, their state has spoken and they must wait to see what the rest of the states do.

I'd read this article but I am not willing to give you $50/year to do it. Plenty of free news sites out there - including AP News - so I have finally closed my CNN tab that has been open for almost ten years. Good bye, CNN.

Duh, do it! Play hardball. If the GOP or the states balk at this, or the Supreme Court try to reject it, fine. At least we'll all be crystal clear on where we all stand on gender equality. Let's hear the right wing media make the case that women should be second class citizens. Masks off, everyone!

Of course it doesn't work that way, but sometimes ya do things that you know don't work, that don't have any chance of success to map a way forward.

The time frame for that amendment expired decades ago. I believe it had to be done with ten or so years. The process would need to start again. So not sure what she thinks she can do. But she can at least try.

The catch is that only in 2020 did the 38th state ratify the ERA. So while of course they should have kept pushing it, at a federal level the discussion only really became relevant again after it passed the 3/4 ratifications required for certification.

Valid point, but the Democratic party exists within the states. An amendment needs national approval, and should be campaigned on/pushed from the top. It would be more appropriate to blame the DNC directly for not coordinating that but they still should have made it happen.

I think most Democratic voters would hate too look under the hood and see how little a real infrastructure there is. When Obama was Pres, it was him, and the IL folks run the show. His 08 team was nortorious for example for not sharing the O For America list with states.

There is a stack of reasons why President Biden is unlikely to issue a silly, ineffectual proclamation that a long-expired proposal is really part of the Constitution, when every court decision has said the opposite. And today we got one more reason why it is very unlikely. bsky.app/profile/eran...

I was at the women's march in October. No a huge turnout. And that's when we thought we were going to win. There are conflicting marches planned for January. The 18th and 20th. Personally, the 20th is too close to the inauguration.

I've seen the 18th remessaged as The People's March. Can't have an event of our own, whatever I guess. I'll be happy if it has more participants than the inauguration. Jan in D.C can be rough.I don't expect people to travel there for the march like they did the original Women's March.
