That is inaccurate. With respect to federal officials, no governor has any legal mechanism (no authority) to declare that person unable to serve or to replace him.

The state constitution says he has the authority to fill the seat. Even the Republican-written 2024 law says he has a legal obligation to issue a proclamation calling for a special election. He needs to do SOMETHING and force their hand.
