It does not make sense to expand the SC until you have reformed Congress. Failure to perform their oversight duties is what has cost the SC its credibility. Require the Senate Judicial Oversight Committee to prepare a list of candidates for the President to choose a nominee for a SC Justice.

Each year the most senior Justice must retire, beginning now. The president will nominate a justice every 6 months till we have 13 SCJs, one for each District Court. That can all be done without an amendment.

Expand the court and you simply expand the number of people who can be corrupted. What we need are: 1) term limits 2) stricter rules (and enforcement of those rules) on accepting ANY additional income beyond base salary (e.g., gifts of any kind, stock market trading, dark money, etc.).

I'm all for expanding SCOTUS...but only once Trump is out of office. If Trump decides to expand the court, we're in real trouble that'd take a century to walk back. Quietly, Democrats should be working on their plan to expand. (I hesitated even writing this post for fear of giving it air to MAGA.)

I really like this solution. bsky.app/profile/libe...

Liberal Currents@liberalcurrents.com

"This is a solvable problem, but a problem perpetuated by one party will not find a solution bursting with bipartisan collegiality. (. . .)It’s a problem caused by conservatives and conservatives are, for now, quite happy with it. So, it will fall to Democrats to fix it."

Also the next Democratic President will have soooooo much of this Trump immunity. Could sue the govt over some one dollar issue, create a billion dollar settlement, pay of student debt with it. Sue again, trillion dollar settlement, free healthcare for everyone. That's how it works now. Isn't it?

We will need to reform the Supreme Court, break the filibuster, and fire every Democratic member of Congress who refuses to liberate politics from money, reforming the Supreme Court and reversing Citizens United are at the top of the list.

We need to think more boldly. The corrupted decisions of the Roberts’ court need to be reversed. Existing justices investigated for corruption and bribery. All future justices get government pay only, no outside anything. Quarterly public audits. IG assigned to investigate and prosecute crptn.

Since the Constitution bases House membership on population, the only way to expand it is to increase the number of people in a state - or amend the Constitution. If we’re going the amendment route, I say make the Senate more representative. It’s now nuts that CA & WY have the same # of senators.

Wet dream is that Dems somehow get the votes to impeach and convict every Trump appointee, including judges. Convict every one. Maybe give judges the choice to resign. Then add seats to the court(s). At least have 13 SCOTUS spots, if not up to 17.

Then every case is heard by the entire court, and once oral arguments are finished, 9 justices are selected at random to decide the case. Make it extremely difficult to tailor an argument to a justice or bloc of justices.

'In regard to 'right-sizing' the Court, my understanding is that cases referred from certain districts gets reviewed by specific Justices ... Since there are 9 Justices and 13/14 Districts, who gets the extra District cases, is it the same Justices each time, or are they rotated among the Justices?

There probably should be a Justice for each District, or maybe even 2 for each, so that the caseload doesn't exceed the Justices 'deliberative time' and except for primary Constitutional cases, an 11-member subpanel could hear any cases accepted! Full court on first cases in Constitutional Issues!

Maybe also should have a rule, that first cases on any particular Constitutional Issue must be filed within 5 years of passage of any bill into law! So, precedent becomes a firm rule that wouldn't be revised by SCOTUS when desired by any changes of party in power at a given moment in time!

To add to this, AG...I just recently read that it's "believed" Trump wouldn't have the votes to confirm a 'replacement' for Thomas or Alito, should either decide to retire... Anyone else hear of this, or am I just late to the party? Republican Revolt incoming...?

Among other things such as: Term limits, full financial disclosure as well as absolute recusal from cases with their involvement. Hell, At this point though- throw it all in the trash 🚮

Arrest Thomas & Alito & Leo & others for bribery. If what they did isn't illegal, then make it illegal & strip their citizenship. There must be consequences. Every mayor & police chief who advocated for broken window police policies needs to feel what that is like for white collar crimes

The republicans virtually stolen 2 supreme picks by separate rules for democrats and republicans so don't be gasslit by their hypocrisy you have to even the scales of justice the court is out of balance and just a political tool for the GOP and limit their terms lifetime appointments is ridiculous

Senate Leader & Republican Leader Mitch McConnell ALREADY CHANGED THE RULES set in our CONSTITUTION by himself! AS ONE PERSON! He REFUSED to allow Confirmation Votes on ANY of President Obama’s SCOTUS Nominees! His madeup NEW RULE was quickly IGNORED when djt was In our WH! EXPAND OUR SCOTUS!

You are correct. It was one of the norms, traditions, unwritten rules or gentlemen's agreements that got shamelessly exploited and steamrolled once Obama was elected and the GOP went into full battle mode. Democrats response was to point at Mitch and say "Hey..."

Democrat leaders (Schumer) were shocked & didn’t know what to do. Which unfortunately signaled to Republicans that they can just SHOCK Democrats into doing nothing to fight back. We need SHOCK PROOF Democratic Leaders who FIGHT right back & also present a NEW PERSPECTIVE of what America can be!

expanding the court won't work, we need to reform how judges are confirmed so a simple majority can't put a partisan judge into a position of great power. Requiring a 2/3rds majority of the senate to confirm a supreme court judge would be a great idea

Sigh I didn't think I'd have to spell this out, but we have to get the House, Senate and White House first so we can pass a law to expand that court that the president will sign. So, no. With a dem in office, we will not get more trump nominees.

I'd also point out this is a move which backfired almost everytime it was tried in other countries. It is also usually a far right proposition. It's what Orbán did in Hungary. You'd be better off with fixed term mandates.

I know it was implicit but I would hate to see the GOP do a preemptive expansion. I cringe everytime I see some one say it on Blue sky.

best if paired with addressing the dark money campaign finance corruption that brought about the corrupt capture of scotus. 2-year congresses fly by. even the better party is limited by pols being pols. we must get them to focus on this root issue reform. i.e., for the people act/john lewis vr act

The most irritating thing John Roberts said recently was how people don't understand why The Roberts Court isn't political. Right John, millions of people are wrong and you know better.

Not while the Trump regime is in the White House. We'll end up with the likes of Aileen Cannon and that yahoo in Texas. I'd rather see the court abolished and led off in shackles.

Roberts was put there to do a job! He waited like a "sleeper cell" for someone like Trump to come along. The rich, religious folks that put him there are finally getting their money's worth. He is delivering.

Thanks, George W. Bush. Roberts was rewarded for providing legal advice to George W. Bush and his brother Jeb during the 2000 Florida election recount. Brett Kavanaugh and Amy Coney Barrett were also part of Bush’s legal team. Oh and Thomas voted to halt the recount. Maybe look into that a bit more.

The thing is, if you expand the court, they'll just say, "Great! We can buy more seats over 20 years" or however long it takes for them to buy a legal system. No. There needs to be a stern process of removal and punishment for violating the trust of an entire nation. +_+ Justice is what's needed.

That actually brings me to another critical element to all of this. The intentionally designed "slow grind" of legislative, executive, and judicial branches has never made any sense. We should speed run these changes this time. If we're gonna do it right and send a message, never do this again. +_+

Defang the court. Severely limit their scope. Establish a new Constitutional court to decide on matters in dispute by lower courts. Have Mrs Alito design a new flag that means "strictly symbolic", and then shove it up her husband's ass.

🎯 • Expand to 13 justices. • Mandatory ethics rules. (same as lower courts) • Term Limits (18 years preferable, no more than 20)

This is such a corrupt SCOTUS and Regime, I don't think expanding is helpful. We need ethics codes for them, investigations, trials and term limits. Our judges are corrupt and have accepted huge gifts, made dirty real estate deals & not recuse themselves when family members were involved. Shameful.

Impeach the judge that should have gone to Obama, impeach those that did not recuse when should have, and jail those that accepted bribes and impeach those that dined with any president as judge.

Other countries have multiple seats per appellate jurisdictions. Maybe we should have 3, or 5 associate justices per appeals courts, plus retirement ages, minimum years of federal service, and the option to hear cases by 9 and then en banc
