If Dems take Senate, he’ll try to replace Alito during the lame duck session. And he’ll probably get away with it. Republicans are that obedient.

Oh agreed, there's no stopping that from happening. We're not cleaning up SCOTUS until 29 with a Democratic President to expand the court. But it would be hilarious for both to resign only for the Senate GOP that have gotten screwed by Trump to block nominees before January.

Now you know those Republicans are not going to help bc they are bought and paid for. I don't know why people expect Republican women to care. They didn't do a damn thing about the abortion ban, but play dumb. People need to vote this November.

Exactly. The time to stop this was 2024. We need to instead concentrate on reforming the court. That is the only way we get out of this and it should go without saying that it's going to be a long painful journey. We have to be as committed to changing it as they were to rigging it.

They aren’t going to step down with the docket already set. Their egos are way too big to give up that opportunity. Alito in the interview is talking about the end of the term too.

Not for nothing, but Biden was head of Judiciary Committee that prematurely ended the hearings and investigation to vote and confirm Clarence Thomas to the Court. Voting Blue may help stop trump, but it's unlikely to fix, and is indeed part of why we have a "broken system." Vote in more socialist.

No, of course not. But I remember thinking when Biden won in 2020 how great it was that Democrats could finally reform SCOTUS after Mitch shoved Kavanaugh & Coney Barrett on the court, only to find out how many Dems are “institutionalists”. That Overton window must shift.

This is my big question. If Dems take both chambers of Congress, and especially if they do so by large enough numbers, will they or won’t they do what needs doing? My fear is not whether or not they’ll be able to, my fear is that they will be able to and just won’t.

Thune is on record saying he could get a nominee on the court between election day and Christmas break, democrats take the senate get ready for this 17th century obsessed justice to announce his immediate retirement

I bet they WILL confirm a new MAGA justice or two between Nov 3rd & Jan 3rd . . . Hell, they might even try to expand the court & fill up to 13 seats before Jan 3rd, since they know that’s what the Dems intend to do . . . they’ll try to preempt the Dems . . . I put nothing past them! 🤦‍♀️

A thousand percent yes. McConnell has established the precedent that the Majority party need not give a single confirmation hearing to any lame duck POTUS. Win the Senate and block all appointments until the WH is retaken in Jan 2029.

He'll try to make an interim appointment anyway. Someone he feels like he can fire and replace if they rule against him. And the conservative majority will allow him to do it.

I mean, I was predicting it going to SCOTUS and Roberts letting him do an end-run around the Senate and make an "Acting Supreme Court Justice" position. Since, you know, he'd only need advice and consent for a PERMANENT appointment.

Alito in the files would be a not surprising shock. Secret creeper? Dobb’s leaker. He’s the religious force (& Leo) killing the Constitution and ignoring the Christian Founders’ insistence on a secular government. His Opus Dei view of women is vile and his piety is based on patriarchy, not Christ.

I suspect he’ll retire well before Jan 2027 (likely after midterms) so the current Senate can ram the confirmation through like they did ACB. I’m sure Fetterman will also join them in a ‘yes’ vote.

I did not think of this as a possibility. Hopefully someone has the energy to bring the Senate to a standstill for three months.

Certainly. Not 60+ days turnover, just a few days or a week is doable. For this administration it’d cut right to the chase. If/when he loses, he moves out sooner, not later. ☮️

Had a few of those lately myself. But these two justices are so ideological that they would consider which party would replace them before retiring. The way the polls are going, surprised they haven’t already quit. Maybe that’s the October surprise

The same actions that Mitch McConnell took when Ruth Bader Ginsburg passed away. Say it's too close to the election to make a decision and let the American people choose.

We need the Senate so the bitter, little, extremist but either can’t retire or yes, the Dems can block another Christian nationalist or that cannonball destroying justice in Florida.

Retire or risk impeachment with a blue legislation. Wouldn't be surprised if his "next year" is January '27 when the blues take their seats and give Trump (and possibly JD?) the heave-ho.

🇨🇦 Good riddance. But Alito needs to bring a few others with him when he leaves. At a minimum, they all need to attend refresher courses on the law and constitution. (And pass an exam)

If Democrats win the Senate, Grand Wizard Alito will immediately retire and the MAGA-KKK Republicans will ram through his replacement in December. They already did that same thing to install Barrett after Justice Ginsburg passed away.

Alito also said that he is considering NOT retiring because he has "more to do." Meaning, he has an *agenda*. Justices with agendas are looking to change/overturn existing law. IOW: He's not done suffocating liberalism.

Lets not be too comfortable & know that its imperative to vote in huge numbers. VOTE BLUE DOWN BALLOT‼️ HELP OTHERS TO REGISTER AND GET TO THE POLLS‼️ DELIVER YOUR BALLOT TO A SECURE LOCATION IF YOU CAN OR VOTE AT THE POLL‼️ VOTE SMART AND BE READY TO WORK THRU OBSTACLES‼️ MAKE NOV 3RD YOUR PRIORITY‼️

C’mon. He’ll retire Nov 1, they’ll have his replacement in on the 2nd. (They’ve done it before).

Don’t be fooled. This is about shoring Republicans up for the midterms. Why would he retire? Name me a better time for cashing in on corruption than today?

By the time a Democrat becomes president, Democrats may not control the Senate. Voters often see divided government as a system of checks and balances, allowing the separation of powers to function.

I’m hoping that everyone is so sick of the Republicans cruelty by then that they are out of power for a long time.

Did you see how quickly Schumer has been folding on things important to the Democratic constituency? How many McConnell judges were denied under Schumer?Did he even fight for Prez Obama to have a judicial nominee? What I saw was Schumer kowtowing to his GOP friends again. Even if we win we might lose

Otherwise, a 40-year-old nut case will be put on the bench for another 40+ years. Keep in mind, a law degree is not technically necessary (it is assumed the Senate will vet that, but we all know how that [doesn't] work). Who knows what crazy cult Trump loving lunatic Trump would appoint?

How can you have a judge that is so biased? You cannot possibly get a neutral judgement This is not justice This is not law

some of you voted for Clinton and have no fucking clue if you think not voting for Harris makes people responsible for Trump, wait'll you hear about NAFTA

I wonder if his self preservation mode activated upon the realization of what the internet is.🤔 He has given the internet connected world plenty of material to work with. 🤷‍♀️ Not my problem to solve. OTP vp

Chuck fkn Schumer (my senator btw) better grow a spin and stop any nomination trump puts forward. I don’t care if it’s years, stop this scotus bullshit.

Do people realize that even if we WIN the Senate, Trump might make Alito retire immediately so he can get a successor installed before January? WE NEED TO BE PREPARED!

Whenever I see, and in particular, hear this guy’s name, I think immediately of the big-talking, super-grassing celebrity miafioso John Alite…which I suppose, albeit in different ways, they’ve both been involved in some form of organised crime and racketeering!

If the Democrats win the Senate, he will retire before the end of the current session. I have been saying for a long time that I think both he and Thomas will retire so Trump can appoint even more radical and corrupt judges. Waiting for Canon to be appointed so I can go at apoplectic.

This is a get out the vote call to Republicans more than Alito actually weighing retirement. He might be but the announcement is a call to action. Honestly, the SC is one of the only things they've got voter pull on so expect this to amplify

If we win the Senate, he'll just retire in that brief interim between November and January and they'll force another fascist through, RGB-Barrett style.

The McConnell Precedent. Play tiddly winks while a nominee waits, say, 24 months for a hearing. I'm sure the right wingers won't mind the extra work (or diminished influence).

Alito and Thomas will both announce retirement on 11/4. They will rush through 2 confirmations before January. Only in this dystopian hellscape is Donald Trump allowed to appoint 5 Justices 🤦🏻‍♀️
