So annoying that Dominion accepted a settlement from NewsMax and Fox. I know legal battles are such a huge drain, but imagine how amazing it would have been for the greatest propaganda machine for the right, having to legally say they lied to all their most fierce supporters

I don’t understand why like the Fox News case Dominion settled. I also wish the oral deposition testimonies were shared with the public…all. The oral deposition testimonies quoted in court filed briefs are probably the tip of the iceberg of damaging and embarrassing testimony under oath.

My assumption is that NewsMax personnel would testify under oath about why they believed what they reported was true. They would be forced to admit they fabricated it entirely or they were told what to report by someone within the Trump circle. The disinformation trail could be traced.

And Newsmax is settling but denying any wrongdoing. It may be just a Canadian thing, but when we see a company settle out of court, that means they know they will lose and just want to settle for less than they would be forced to pay by the judge or jury.

A judge already adjudicated them to be liable. If it had gone to trial it would just have been a matter of a jury determining malice or not and assigning damages on the basis of that determination. Newsmax clearly didn’t want to take that risk.

The same is true in the US. A small settlement, sure, that might just be making an annoyance go away. But multi-million dollar settlements? Most rational people assume that's a "we really don't want to air this dirty laundry in public" payment.

Fairness doctrine could not apply to cable channels like Fox or Newsmax. It only passed 1A muster when applied to radio/TV broadcasts on open air, and there were limited licenses available due to physical limitations on how many stations could broadcast without interfering and becoming unreadable
