If you have lived life in republic where people voting to touch the stove has never had profound, understood negative material impact because it was managed away – something was already broken and someway possibly inevitable. Break the feedback loop of a market or idea, you eventually break it all.

This is such an important facet of a much larger idea but it is so misunderstood on its own I might just delete this. Resentment of a "deep state" is downstream of legislature that rules by omnibus bill with no votes for ideas or policy. Leaving a state trying to continue in absence of a pillar.

As I have said long time, the court really did take over the job of social issue response with pressure relief votes as legislature deferred. Executive agencies really did take over the job of creating legislation as the legislature became evermore calcified. Everything is the legislature breaking.

The thing with criticism of the court and executive exercising undue powers... is they are some degree vulnerable to it. But they were sort of forced into this position as the legislature absconded its responsibility to represent the people and their interests. It all just really sucks really bad

I don't know if people are in an information vacuum or are they strategically don't acknowledge it, but there is like a lot of very iffy executive actions and constructed court precedents that built your world and you like me probably like. But that was something the legislature was supposed to do.

The EPA did take regulatory action of profundity they "should not" have. The department of education did issue incomplete regulatory edicts they "didn't" have power to. There were arbitrary and capricious executive actions. Based on issues the legislature should've addressed in some amelioration.

This is probably a level of maturity of challenging how we got here today that is unwise. Because we did get here somehow. And it's not because of their story. But it's not the cleanest story that makes you feel the best, either. It's full of intractable hells and adaptation.

The founders knew that at some point we'd elect a lunatic, a thug, or a venal criminal as president. They built a system that was hardened against that. What they did not plan for is that one branch would be completely captured by the president's political party...

Yeah, we’ve been in a low grade “competitive authoritarianism” for decades because the laws haven’t mattered. Presidents telegraph their “enforcement priorities” and laws disappear. Or direct their departments to make new regs and there’s a law! Then the rich get to opt out in court. Good system!

The Roberts Court is a major part of the reason the legislature failed, from Citizens United to bribery to Voting Rights. It was their strategy to shift power to themselves and their patrons. They mocked us by striking down old laws and executive actions and saying the Congress they broke could act
