Here's your weekly helping of Beau & Tell Scholarship with references to @katejackson.bsky.social @mtokson.bsky.social and others! I highly recommend Kate's new substack and Matt's tremendous (albeit bleak) new paper on "Near-Total Law Enforcement".

Almost typed, โ€œreally wish I too could have a disordered attachment to the Cheesecake Factory, but not in this economy.โ€ Couldnโ€™t pretend that if I were awash in cash, Iโ€™d really be spending it at the Cheesecake Factory of all fucking places.

I mean yeah, but also, weโ€™re like a decade into serious court packing conversations, and nobody on the left flank has tried to instututionalize. Very woeful. Also, its a good reason to distrust that anything serious is gonna come out of 2028.

I agree with that buddy! I always been impressed by the conservative communityโ€™s commitment to mentoring and organization. The legal left is obsessed with hierarchy.

A major problem on the legal left (more narrowly construed) is a severe lack of institutionalization.

A helpfully clear exchange here Hasan: "So your argument is that [Minnesota ICE protesters] should stay at home because immigration is a salient issue for Donald Trump. Opposing ICE is only going to help Trump. Wait until we win the election in 2028." Yglesias: "Yes that is what I would have said"

I just think we should recommit to brakes on hierarchical political authority. Sometimes, there will be costs to that commitment.

Marty Lederman@martylederman.bsky.social

What Jamal said. Do you think the POTUS and agency heads would get better legal advice from agency general counsels? From the White House Counsel?

As usual, @beaubaumann.bsky.social articulates the intellectual stakes of our shared project wonderfully: Instead, if industrial policy, administrative democratization, and countervailing power are to succeed, they must be embedded in a settlement that restores legislative primacy.

OLC, OIRA, ICE. Time to rediscover the subtle art of rat fucking institutions that are designed to screw you and yours.

I see that there is a wapo story a few days ago about the office of legal counsel so this is my cue to remind you that the best time to have abolished OLC was the day after it was formed, the second best was the day after torture memos, and the third best is today.

I donโ€™t really understand bad faith accusations against the Court. They seem to assume a far more serious mode of governing authority than whatโ€™s on offer.

Me: โ€œSCOTUSโ€™s juristocrats are a threat to democracy.โ€ Liberals: โ€œvery dangerous talk young man.โ€ Juristocrats: โ€œSCOTUSโ€™s juristocrats are a threat to democracy.โ€ @jpygold.bsky.social

A thoughtful post! Ironically, the thing that Vladeck and I agree on is that you ought to go in w/the expectation that the GOP retaliates. In the process, they destroy the juristocracy.

Whenever Iโ€™m rarely asked for advice on writing, I usually baffle my interlocutor by offering something along the lines of: โ€œinvest in a balling-ass robe.โ€ I seem unhinged in the moment. But then fall rolls around and I appear like a prophet.

Okay, I'm just going to acknowledge that I should already know this and whateva. If I'm doing a parenthetical quotation that is a translation of a non-English text, how do you communicate that it's a translation in a bluebook footnote?

Loved this article by @beaubaumann.bsky.social โ€” the phrase about "hospice care for a beleaguered republic" gave me goosebumps for real.

@andrewtorrez.bsky.social sounds like an old-school liberal. Like he talks about his appreciation for Dworkin. So there's some very totally fine pushback on my piece, which I very much appreciate. Frankly, hearing Dworkin stans go for Ct reform is enough for me LOL. Perhaps a sign of the times.

Thanks for the kind words! Prof. Baumannโ€™s article is a great think piece & we all need to have our baseline assumptions challenged. I am on record (video, even!) in 2017 arguing against court expansion for essentially Vladekโ€™s reasons. But 2025+ SCOTUS is justโ€ฆ not a court in any sense.

it would deploy its new powers and warrants against the Republic. There were, in fact, people of the left who said this in real time!!!! Legal liberalism was defined by an arrogance so astounding that it is only matched today by the likes of John Roberts.

, which is really a barn burner. This relates to your point about whether or not liberals deserve some of the blame here. Historically, people of the left (broadly understood) understood that they were in opposition to juristocracy.

Thatโ€™s the Republicans after Dred Scott, Black folks after SCOTUS decides to kill Reconstruction 1.0, and Progressives, and New Dealers, yadda yadda yadda. It was entirely predictable that if you strengthen an institution set against multiracial democracy in the long run, ...

Second, when I write about how the Court is pretty pathologically set against American democracy in the long run, I just think Iโ€™m being sort of boring. Like, thatโ€™s just Bowie & Renan, along with a ton of other folks. Thatโ€™s not even going full Aziz Rana in The Constitutional Bind...

I just offered them a reply on Substack, and I thought I'd reprint it here in case it is of interest. "This is a fun convo. Thank you for engaging with my work :) Two things to chew on (food for thought). First, the Warren Court didnโ€™t really lead on civil rights.

After the bang of Brown I comes the whimper of Brown II (โ€œwith all deliberate speedโ€). All said and done, the judiciary did practically very little to desegregate the South. And what little that was done was operationalized by lower court judges in the old CA5 . . . .
