The promise of originalism: the far right invented a faux jurisprudence to maximize far-right outcomes, pretended they discovered the secret inner thoughts of the founders, reduced it to a bumper sticker slogan & campaigned on it The critique: we laughed at these dweebs until it was too late

WELKER: Is a vote for you a vote for the Trump agenda? MIKE ROGERS: Um, I'm apologizing. I'm having some difficultly in my earpiece. But is a vote for you? I'm not sure. I'll tell you what a vote for me is. It's a great day for the state of Michigan

NEWS — The Trump administration sued Alaska over Dan J. Sullivan’s Senate candidacy, arguing voter confusion could affect the race between Sen. Dan S. Sullivan and Democrat Mary Peltola, per Courthouse News.

2/ ...this reasoning in particular was just amazing. Oh, NOW we need to divine the true intent of voters who may be confused?? How about this: we'll give you Dan Sullivan's votes if we can retroactively award those 3,407 votes for Pat Buchanan in Palm Beach County in 2000 to Al Gore. Deal?

Somebody paid money to find out that Hunter Biden is slightly less unpopular than Don Jr which is, on the one hand, an utter waste of money, but on the other hand, hilarious.

Yea there’s been massive Democratic fraud in Utah, few know this

BREAKING NEWS: Lt. Governor Deidre Henderson announces the DOJ intends to send election monitors to Utah: www.fox13now.com/news/local-n... #utpol #Utah

Yes, the first part is outrageous, but the rest is *also* an outrageous multi-part lie. After (falsely) claiming that Merrick Garland was equally Biden's lackey, Blanche says "I'm not being critical of that" - despite having filed motions to dismiss Trump's criminal cases for that alleged reason!

Ken Klippenstein@kenklippenstein.bsky.social

Attorney General Todd Blanche says there's a "misperception that there's this separation and independence between the Department of Justice and the White House." "I work for President Trump."

Trump’s efforts to tear down the East Potomac Golf Course in open defiance of a court order is about much, much more than golf. Another must-read from @lizdye.bsky.social for @atrupar.com.

Aaron Rupar@atrupar.com

1/ Alex Jones's lawyers requested - and got - two separate extensions to file their appellate brief at the 5th Circuit on the InfoWars IP. They missed both deadlines & filed the brief three days late anyway. Now the court has ordered "no action" while it figures out whether to strike the appeal...

And here I was thinking I’d have to stop writing about Alina Habba because she quit pretending to practice law

Ken Vogel@kenvogel.bsky.social

NEW: A firm started late last year by the family of the Venezuelan banker Julio Herrera Velutini offered to pay Alina Habba $10m/year while she was an administration advisor. Weeks after she started at the company, Trump pardoned Herrera Velutini, who had been charged in a bribery case.

See? We drop a super long podcast when you have a super long drive!

Michael@norfolkrules.bsky.social

@lawandchaospod.bsky.social @andrewtorrez.bsky.social @lizdye.bsky.social It was GREAT having such a long podcast today on my drive home from Raleigh to norfolk after dropping my kiddo off from visiting home for a long weekend.

Kind of weird that Susan Collins thinks the best way to hold on to her Senate seat is to try and convince voters that she’s not *really* a rubber stamp for Trump, she’s just completely fucking stupid.

Aaron Rupar@atrupar.com

Susan Collins on Kavanaugh: "I'm very disappointed in his his vote to overturn Roe v. Wade. There was no way for me to anticipate that."

Thanks for the kind words! Prof. Baumann’s article is a great think piece & we all need to have our baseline assumptions challenged. I am on record (video, even!) in 2017 arguing against court expansion for essentially Vladek’s reasons. But 2025+ SCOTUS is just… not a court in any sense.

Beau Baumann 🍎@beaubaumann.bsky.social

But hey this pod seems like a total banger. I learned a lot from the front end too. Let me know if y’all ever wanna chat about this stuff more. :)" Thanks for the engagement and great pod @andrewtorrez.bsky.social and @lizdye.bsky.social

Why is the 1987 Bruce Willis/Cybill Shepherd vehicle “Moonlighting” at the center of a bizarre outcome at the Supreme Court? There’s only one way to find out!

Krashonista@krashonista.bsky.social

@andrewtorrez.bsky.social Moonlighting. First- kinda holds up. Second - it just came to streaming a couple of years ago. It (apparently) was a nightmare process because there is pop music throughout- which required a near Sisyphus level effort to clear with copyright holders.

For the past 20 minutes, the court's hearing has apparently been moved to the inside of a wind tunnel located next to a cell phone dead zone. I can hear every other word, but only punctuated by long whooooooooooshing sounds.

If you've been waiting to get into the hearing before Judge Reyes which YES IT IS STILL GOING ON FIVE HOURS LATER, the line is now open to the public: 833-990-9400 PIN: 787605272

This is the most important development if you followed the set of questioning out of the box this morning when Judge Reyes asked DOJ lawyers who would be willing to sign the reply brief filed yesterday (that was full of lies). She is NOT interested in having a sanctions fight (at this time).

Roger Parloff@rparloff.bsky.social

Judge Reyes: late breaking news. i'm going to withdraw request that DOJ refile yesterday's brief with identification of who signed it. we've all got better things to spend our time on. when dept is providing briefs to court, attys in case should put names on brief. if they don't, ... /184

I think the state is degrading faster than people realize. People who place their hopes in 2028 need to set their expectations around a state that is greatly diminished and set on a downward trajectory. Arresting the decline is itself a generational task.

The dial-in line for today's golf course hearing before Judge Reyes in DC is borked but Roger Parloff is doing yeoman's work liveblogging it:

Roger Parloff@rparloff.bsky.social

At 10am Judge Ana Reyes will begin an evidentiary hearing in the golf course case at 10am. I'll try to live-blog from the US Courthouse media room for @lawfaremedia.org . This is a case to stop Trump from converting a historic public golf course, open to all, to a Trump style championship course.

No no this is fine. The DOJ said last night that it violates executive privilege for the court to look at presidential statements to divine his real intention.

I’m assuming Trump insiders sold their Kalshi contracts on Netanyahu minutes before this Truth Social post went public.

MeidasTouch@meidastouch.com

Trump issues a "Complete and Total Endorsement" of Netanyahu, warning Israelis that if they elect anyone else, "America will have to do this work ourselves" in Iran. He calls Bibi an "even greater Partner for Peace" for waging the war with him.

1/ In a 2-1 decision authored by Trump appointee Allison Rushing, the 4th Circuit holds that Virginia schools are entitled to bring a declaratory judgment action over the Dept. of Education's Office for Civil Rights to strip public schools of funds for *NOT* discriminating against trans students.

4/ Richardson (another Trump appointee) wrote the dissent saying that this is at its core a dispute over money. He's not *wrong*, exactly -- the school districts do want their funds back! -- but he's willfully pretending that this isn't naked viewpoint discrimination against trans kids.

5/ Judgment has been entered and not stayed - this case is going back to the district court unless SCOTUS jumps in to stay the 4th Circuit's order - which I think is unlikely (but I'm sure we'll find out).

2/ The gov't argued that the dispute is really a Tucker Act claim & thus belongs exclusively in the Court of Federal Claims, an oddball court that only has the power to award money, not declaratory relief. IOW, the administration argued that its political retaliation was a mere contract dispute.

3/ The 4th Circuit refused to endorse that pretense. It's heartening to see a very conservative, ADF-aligned Trump appointee - reportedly on Trump's SCOTUS shortlist in 2020, even! - refuse to buy into the administration's framing that this is akin to not paying the guys who install signs on I-95.
