Good morning from Camp Justice at Guantanamo Bay. The USS Cole case hearing is in recess for the judge to consider the defense team's claim that the defendant is not competent to stand trial. They blame the torture he endured in CIA custody. An Army psychiatrist found the prisoner competent.

I'm going to say this for probably the 20th time now .... Comey was an Original Classification Authority at the time he allegedly disseminated the national defense information at issue here. Assuming it was FBI information, he had the authority to declassify it at his discretion.

The NYT — having been shamed for years for not posting court opinions — now does so, but only with its enraging workaround of posting a link to a page that has individual images of each page of any opinion. So, here, you load a page of 55 images that are completely unworkable for any future use.

You realize because it got a reaction, Trump is now going to riff on Nicki Minaj's ass in every rally until election day.

Read this post if you're worried about securing the midterms from the Trump administration. I'm not saying it will end all your fears, but it will help to contextualize what's real and what's not.

Okay, that was actually fine. Listened to oral argument in the DOJ's effort to purge CA voter rolls with voting ongoing. The panel is clearly going to split 2-1, or possibly 3-1 against the government. Crisis averted ... for now.

Something that's not being said. The REASON why Blanche and Bill Essayli are so defiantly violating the Constitution is bc John Roberts said they can't be prosecuted so long as they're following Trump's illegal orders. Blanche's criminality arises DIRECTLY out of Trump v. US.

The hand-wringing over the Lindsey Graham thing "because he's not here to defend himself" strikes me as absolute bullshit. People who seek positions of enormous power and influence are not entitled to the sanitized legacy they'd give you. They should be remembered for who they really were.

The indictment looks bad as a matter of appearances but these aren't crimes, SCOTUS said so. Official acts on an "as-needed" basis? Nope, McDonnell, 579 US 550. Undisclosed self-dealing? Nope, Skilling, 561 US 358. Problem here isn't just the timing, the legal substance itself is dubious.
