The court required them to file a pleading that satisfies 24(c) as a condition of intervention. This is that. The interesting question now is whether they'll seek an interlocutory appeal from the denial of the motion to dismiss.

Also, beef liver is really not a tasty dish, I’m sorry. If you want to campaign on the notion that everyone should eat beef liver, go ahead.

The US as an intervenor in a citizen EPA action has filed a crossclaim seeking a declaration that the US can dismiss the NAACP's (or any citizen) EPA complaint. Among other things, this is unusual because the district court this past week just held that the US has no right to dismiss the action.

Like oh hey, 10% chance we accidentally unleashed the terminator. Sorry! But is there even a 1% chance you get flying cars and a working roomba? No there is not.

I would do away with pre-conviction pardons.

Ann Hornaday was a stylish and fearless film critic who taught me a lot about what the job should be. News of her death is gutting. I was honored to edit Ann in May on a piece about ALL THE PRESIDENT’S MEN, her obsession. She was finishing a book on it. www.latimes.com/entertainmen...

Congratulations to @briangoldman.bsky.social on his nomination to serve on the California Court of Appeal. Having had the honor to work with Brian at DOJ and Orrick, and knowing how brilliant, fair-minded, and thoughtful he is, I can’t imagine a better choice for the role.

Adam Feldman analyzes greatest attorney impact in recent appellate cases: "The top of the leaderboard begins with a civil-forfeiture appeal from the Ninth Circuit. In the midst of an emergency for a client, the GC of new client in a different case (knowing of the emergency) just sent me a dad joke as a friendly distraction. Much appreciated. And an early happy Fathers Day to all you dads-may you all enjoy your dad jokes & your families on your special day.

So what prevents like the FBI from setting up an AI and collecting confessions?

Kathryn Tewson@kathryntewson.bsky.social

Okay, NOW it asks me to confess to the crime. Well, it’s the robot lawyer, it probably knows best. I appreciate that it thanked me “for being straight with [it]”. I’m helping!

I don't pay much attention to most lawyer rating services. But Chambers interviews clients & lawyers in the field. So, I appreciate the high ranking of our Orrick appellate group (chambers.com/department/o...) & my Band3 ranking. Most of all, I appreciate the generous comments from those interviewed

Not only that: The interpretation would also invalidate executive and judicial appointments made during the Biden Administration. Nullify two years of Democratic control of the Presidency and Congress with “one neat trick”

Random thoughts from recent travels (part II) — Almost every trip, I see travels taking call (on ear buds) in the bathroom/while using the bathroom. Why does anyone think that is ok?

Random thoughts from recent travels — At a nice hotel in Florida, I found dirty clothes in the drawers. (They hotel moved me to another room). I mentioned to a colleague and he said he had never opened a drawer at a hotel. Never!! Is that common?

Good news! The Supreme Court (after rescheduling it 10 times!) denies cert in Littlejohn. Parents of a middle school student sought cert., arguing that their substantive due process parental rights were not sufficiently respected when their child requested to use a different name and pronouns.

I knew something was up when I saw Kannon enter his name into the appellate transfer portal

Second big appellate move in one week! Shades of the week that Lisa Blatt, @kannonshanmugam.bsky.social, and @johnpelwood.bsky.social moved in quick succession.
