The anti-Project 2025 education policy playbook for progressive states must include OFFENSE not just defense. I will post my top 10 offensive moves below. What are yours?

Reupping my warning that opting in to the fed voucher program could undercut STATE LAW challenges to vouchers. New fed rules say states can’t add conditions, so vouchers become a cost of doing business factored into state budgets. You can’t call vouchers unconstitutional, then join the scheme.

Prof. Cowen is most knowledgeable on this subject, his “go get the money” points here are well-motivated and he thoughtfully anticipates and addresses many counterpoints. I’m still unconvinced. I remain concerned about a point he mentions but doesn’t--for me--convincingly address... 1/n

Looking forward to joining a fantastic lineup of scholars at the Arizona State Law Journal’s “Education at a Crossroads: Law, Power, and the Future” symposium on November 13, where I’ll be moderating a panel discussion on “Education, Civic Participation, and Democracy.” Join us: bit.ly/3WMuTxR

Honored to have been selected to join the inaugural cohort of Early Career Education Law Scholars convened by the AALS Section(s) on Education Law and Children and the Law! I couldn’t be more grateful for the opportunity to share my latest research with such a welcoming community of scholars.

Pretty cool scholarly milestone: my article, Administrative Exhaustion after Perez, has been cited in a petition for a writ of certiorari filed with the U.S. Supreme Court.

In D.C. v. Fairfax County School Board, petitioners cite the article in asking the Court to resolve a longstanding circuit split over administrative exhaustion under the IDEA, including the circumstances in which systemic or structural claims may proceed without first being exhausted. /2

Some pretty staggering numbers from ED-OCR: the office began 2025 with approximately 19,000 pending complaints, received a record 23,879 new complaints that year, and resolved roughly 1% of its pending inventory. OCR’s inventory now exceeds 40,000 complaints and grows by about 2,000 *per month*.

Great framing of one the major challenges confronting the Left's broader reconstruction effort. The way I've been thinking about bridging the gap is by focusing on the problem of power disparities. I applied this framework to the issue of regulatory public participation. fas.org/publication/...

New from me: what would a grand coalition for government reform look like post-Trump? It should include both people who care about democratic backsliding and state capacity. But right now these groups aren’t really talking to one another. 🧵 donmoynihan.substack.com/p/what-could...

Yeah. A lot of this -- most? -- is absolutely willful ignorance. Especially when said about the South. Any good faith critics of this nature seem to confuse strategies with tactics. He built a toolkit of tactics specific to New York but his strategy is just functional, responsive governance.

The belief that Mamdani’s politics are limited to New York is giving the same energy as “there’s no way a Black man from Chicago, raised in ‘exotic’ Hawaii, with the middle name ‘Hussein’ can become a national figure, let alone win the presidency”

The same administration that (with SCOTUS's blessing) says bans on conversion therapy violate the First Amendment is going after professional organizations for *recommending* gender-affirming care, something that is far more clearly pure speech.
