I wish the internet were like chairs. The chair I got a decade ago doesn’t overnight start sharing everything it knows about me just because I kept sitting on it…(context: the backlash against Meta’s ever changing data use policies that Americans can’t opt out of)

Watch this with Trump at his side, remember the dissents in the birthright citizenship case — www.lawdork.com/p/six-opinio... — and understand there are no limits, no places they wouldn’t go.

Rally speaker: "Mike Rogers is an American. Abdul has a birth certificate. The birth certificate says he's a citizen of America. You know what? a birth certificate doesn't make you an American."

Is it just me or is this quote from the Fifth Circuit majority opinion on the bond hearing question giving vibes of Kavanaugh’s take on ICE stopping and targeting people based on how they look or speak…compare:

Chris Geidner@chrisgeidner.bsky.social

BREAKING: Fifth Circuit, on a 10-7 vote, says no bond hearing for detained immigrants pending removal proceedings, no matter how long they're detained — reversing panel decision and district courts. www.ca5.uscourts.gov/opinions/pub...

From all the reports I’ve read, it’s not easy to just fly away if you want to just leave. I am recalling a British cartoonist whose family had to raise a fuss to get her out of ICE detention)…https://www.prospectmagazine.co.uk/views/people/73617/the-comic-artist-detained-by-ice

In the NYT article, the judges explained what happened to the rule of law this winter in MN, from the view of the MN federal district courts. And now the DOJ claiming that (their concern for the rule of law, mind you) means they can’t be impartial towards the gov’t.

And here is an example from an order from Judge Tunheim in early 2026, in response to the Government’s failure to respond to court orders.

And here is a portion from the Guide to Judiciary Policy that specifically points out the rule of law as an acceptable topic for speaking out.

One thing I couldn’t stop thinking about as the justices argued about the video tape law applied to today is how any times I’ve heard that existing law can be used to address harms from AI. Ok, I see the logic. But how many justices will be like “nope that law says nothing about AI!”

It was so fun to be able to connect my work drawing the courts with this conversation @slate.com has been having about popular constitutionalism! Thank you, Amicus team!

Very pleased to share this final installment of our By The People series, a live show on reclaiming constitutional meaning for the people themselves. Much needed insight and inspiration from @staceyabrams.com and @ilyseh.bsky.social and @daphnarenan.bsky.social.

Expanding the Court is the moderate position

For example, a textualist reallllly shouldn't care about this. So why bring it up?

Maddy Buck@maddybuck.bsky.social

This has been weird to me since I learned in law school that legislative history was apparently uncool (but it makes so much sense?). I just am not convinced that complicated textual arguments are considered in a vacuum. itsmaddybuck.substack.com/p/does-a-law...

I'm a week late (drawing is slow, guys!) but I just love Justice Jackson's reminder last week (Salazar v. Paramount) that legislative history doesn't have to be uncool...and Paul Clement's little attempt to win her vote, just in case... This is how conversations change, isn't it?

Love it! Also, the book to read if you're feeling like everything re: SCOTUS is hopeless. The conversation can change, it's changing!

Ooh thank you for the marketing idea. You heard him, folks: The Originalism Trap is *the* rival of Alito's book Learn why his opinions deserve to be dunked on, how they became the law of the land anyway, and what we can do about it! www.penguinrandomhouse.com/books/735353...

Just going to be straight here — no pun intended: I am the only journalist who has been covering this issue in depth, was often the only journalist at hearings, and was the only one explaining what DOJ was actually arguing here. Support my work if you can: www.lawdork.com/subscribe

BREAKING: SCOTUS rejects Trump admin's request to allow it to end gender-affirming medical care in prisons — a significant, if tentative, rejection of one of the admin's most extreme anti-trans arguments. Only Thomas and Alito noted they would have granted the stay. More to come: www.lawdork.com

Got to make the tiniest appearance on this podcast this week as “the artist who draws the Constitution” alongside the knitter who knits it. Dear knitter, I would love to see a photo of that knitted document!

Anyway: the idea that her citizenship can be undone beyond the statute of limitations because someone else committed a crime (even if true) is not something that we should tolerate.

Clement and Sotomayor are fighting over what a "consumer" is now. Because the videos from 247sports are "free" Clement says they're not "consumers" of the videos, and thus not protected by the law. IF THE PRODUCT IS "FREE"... *YOU* ARE THE PRODUCT!!!!!

Imposing 18-year term limits for justices would improve the Supreme Court by ensuring no single person has generational power, by giving each president two appointments per four-year term, and by lowering the stakes of the confirmation process. bit.ly/47DWAuZ
