SCOTUS reform won't just simply happen if Dems take Congress & the White House. A case has to be made for it—to a skeptical public, to reluctant politicians, to a hostile media. The blowback from the right will be intense and terrify a lot of weak-willed pols. The case has to be made starting *now*

I'm not criticizing these responses to dunk on Dems. I'm saying that powerful people utterly misunderstand the moment and are missing a critical opportunity to make the case for SCOTUS reform. I even wonder whether they understand the need for it.

Once full racial gerrymander takes hold in 2028, the House will be permanently MAGA. It will block everything, incl court reform. Only court "packing" appointments will be able to undo, and only if anti-MAGA hold White House and Senate with will to do it.

I just need someone to make the case that all of the Dems, Greens, and DSA types who refused to lift a finger to protect the majority in 2000 or 2016, or even 2024, won't come up with yet another excuse to hand new vacancies to Republicans. And that includes Bernie Sanders' spokeshag and the Chapos

"whether they understand the need for it"? Really Dave, Surely you jest? You must be one of those W.E.I's.whom lack the tolerance for your fellow citizens bc we're designated the"OTHER"? C'mon Dave,Scotus has deprived us(melanated)of our lives, liberties&freedoms premised upon"RACISM",the USA's"GDP"?

Heh, remember when the Biden administration commissioned a study about this to satisfy an election promise and then never talked about it again The majority of the Democratic party is populated by HR types whose #1 rule is 'don't rock the boat'

Republicans griped about the "liberal court" and Roe v Wade for decades before they were ready to embrace the hardball maneuver that McConnell pulled with Scalia's death that precipitated the current crisis. Liberals need to be willing to play the long game as well, and I'm not talking about just/

And it has been proven that giving no quarter, aggressively stating your position as incontrovertible fact, goes a long way to mollifying the press and the public.

Court reform won't happen without the votes to do it. It won't happen at all next term because Democeats won't have a veto-proof majority in the Senate (or the House). 2029-2030 is the best bet, but they'll need enough votes to bypass the filibuster even then. That should be the focus.

And, as posted before, one step in this direction is to eliminate the language of "court packing". Making the argument that justices are responsible for circuits. There used to be same number of justices and circuits. There currently are 12 circuits, so a minimum of 11 justices is right-sizing.

No, the whole institution is anti-democratic and shouldn't exist the way it does. If I got to choose we would ideally eliminate Marbury v Madison because judges were never supposed to have this power in the first place.

That power filled a need in the constitutional framework, and we’ve muddled along for 200+ years. I don’t think we’d be having this conversation if conservatives hadn’t packed the court. There are a lot of obvious ways to make the country more democratic, start with ranked choice…

A big push for Court reform could see Dems blowing their political capital like they did w/ the Mueller investigation etc., inviting another round of blowback. Better to focus on governing competently and writing legislation that does what it needs to do. Keep taking about universal healthcare.

I think they just made the Case, Nov has to be Won for Scotus reform to Begin in process. But make no doubt, The Supreme Court Just Made the best Argument for an increase by 4 . Believe That ...

Democrats refuse to make the case for anything. Except if a couple DSA candidates win primaries. There’s a crisis. They’re fine with the court and nearly everything else, if not actively complicit, and they prove it over and over again.

I think court reform can’t publicly be an aim in itself, rather a strategy in service of an extremely popular aim. When this court stands in the way of what the public wants, immediately, decisively destroy it. My vote is nuking citizens united. Biden wasted chances with bad communication.
