The Right to Privacy, which the Supreme Court in prior rulings agreed to, was the foundation for granting the legality to Interracial and Same Sex Marriages against the States who made that illegal. Clarence “Uncle” Thomas does not believe in the Right to Privacy.

The Court didn’t reject the appeal out of principle, it was just a bad vehicle. Don’t mistake strategy for mercy. They will go after Obergefell next. Saying otherwise is like pretending they didn’t overturn Roe. Christians preach love while legislating hate.

This is terrible writing. This is not what the verb "to garner" means. You need a verb meaning "create" or "engender" E.g. the writing at Forbes is unlikely to garner any accolades for which no payment is made

Pretty sure that given the wording of the declination, that this will be revisited in a new way and fast tracked to get back before them. Both Thomas and Alito have publicly stated they want to review it. This isn’t over by a long shot.

Exactly. I post often: I’m not a Constitutional Scholar, just a retired EMT, if I can see this, where the hell are all the people who ARE Constitutional Scholars and WTAF are they not screaming right now? So much culpability at so many levels. Breathtaking.

All too similar to Chairman Mao's CCP Manifesto with changing from brutal to excessive brutality. Conquistadors? Puritans? Andrew Jackson! Confederacy Ingrates KKK Evilvangelical Dixiecrats? None process as Human Beings with 36 Trillion God Particle Body & Brain Cells stored within.

The problems will be if he, breaks convention & stays in power, or if his acolytes continue their purge. Slowly the democratic realities will slowly disappear, under the guise of 'it's needed & is good for the people'! Beware, what politicians do is never, for the benefit of the people!

Critique of same sex marriage has always pointed out this is a wealthy white male issue, hence it gets traction. Abortion? Women? Nobody cares if those rights are taken away.

And #SCOTUS should rescind their decision on abortion. It's the same damn religious bullshit. We don't need #Religion telling us how to manage our own bodies, much the same as we don't need #KimDavis telling us who to marry. Religion: OUT OF MY GOVERNMENT!

So they're going to wait until after the midterms, then. This wouldn't have had the scope the Roberts court truly wants. It's frightening how few states have their own protections. And we know state "freedom" rights are just a prelude to federal enforcement.

Odd, given the corrupt, anti-democracy, conservative, right wing, theocratic, Christo-fascist leanings of our Republican Supreme Court for the next several decades. I suppose they considered there was no money to be had just now, so why bother? Just get to it later?

They declined to grant Cert as she filed her amicus brief late per court procedure They are attempting to use process as a fig leaf. If they blatantly accepted her thin case, the backlash would have been catastrophic They will certainly act on a new filing with a different applicant and approach

Why wasn't it overturned? Because one of the first things that Congress did was to codify same-sex marriage in the law after the Obergfell decision. That's what makes the difference. Get the decision of the precedent-setting case first, and then craft/revise the law around the decision.

We got lucky this time. But we cannot trust SCOTUS to do the right thing every time. This is why we need to replace SCOTUS given rights, with actual laws passed by Congress. As soon as Dems control the House and Senate, they need to pass laws to keep what we have.

They are waiting for a better excuse to remove more rights. The fact that they were even debating it should be a sign.

I was sure they would since 6of9 our pro25, glad they didn't I know far to many loving couples that don't deserve to be judged by any one, needless to say those that want to that us back to an authoritarian regime

Meaningless victory. The only issue that would have been considered was whether she had the religious freedom to not recognize same sex marriages in her job. Doesn't mean that they won't take up the issue of the validity of federal recognition of same sex marriages over it being a state issue.

I feel somewhat safe since Kavanaugh was handpicked by Kennedy and Kennedy considers that ruling a crowning achievement. Don’t think Kavanaugh would overturn while Kennedy is alive at least. Roberts also seems against overturning any decision his court made because it makes him look insanely bad.

The widespread fears were unjustified. A lot of people ask the Court to hear their cases. Few of them succeed. And as bad as the Roberts Court is (it’s awful), I can’t imagine anyone who would want to use a bigoted moron like Kim Davis to establish a precedent for anything.

Look if marriage was purely a religious thing and had no effect on anything legal Sure let the Christians have it They still wouldn't be good christians But still But as we all know that isn't the case

Forbes, why are you acting as if the Republicans aren't maliciously evil nazis trying to destroy all human rights? Nazis want to take hard won human rights, like marriage equality, and you're not vocally opposed to the nazis!? You know that makes you collaborators, right?

the article is like four "paragraphs" long of which three are bullet points this isn't about republican actions nor the davis v ermold case; republicans just aren't relevant in this article seeing as the aforementioned case isn't elaborated on why would they talk about republicans here

this is an isolated piece though? it literally covers one topic and doesn't stray from it; ope nevermind it's being updated live from what i can seem but still, it's not about discussing the issue via a party-lens and sides it's about discussing the rejection of the petition (and with 1/2

Same sex marriage will not be overturned. The right is not as far right on these issues as they use to be. It’s commonly and respectfully accepted that two individuals of the same sex can get married. Now when it comes transgenderism and how it affects kids…that’s a different story.

Davis would've been a very weak case - she keeps claiming that she should be allowed to establish her religion as the official policy for who the state should permit to get married, which makes it even more clearly an Establishment of Religion issue and not just privacy/etc.

That’s bc they want to move fwd w/ Department of State v. Muñoz, which would allow states to chip away at marriage equality rights under the “religious liberty” bs. They’re looking to gut protections because according to Comey, rights that stem from marriage are not constitutionally protected.

Surprising, Con Server SCOTUS would turn down overturning Goodness to Humanity. "God Hates________ by CCP Manifesto 2024 White Christian Standards? Not a time to RELAX, Enslaved Labor Town Camps not yet on Active Docket. Nor Roman's Crucifixion Law for non-conforming to Blondes High ASP Standards.

Pervert Clarence Thomas still wants to attack Gay Marriage. For young people, in Thomas’ nomination hearings he was accused of sexual harassment by Anita Hill who was her boss. She worked for Clarence Thomas at the U.S. Department of Education and the Equal Employment Opportunity Commission.

Don't hold your breath. they overturned wade VS roe. Half or more of the justices are incompetent .appeals are thrown into the wind making legal interfaces on things that are not within constitutional binary situations. It will take generations before it could be acceptable without the courts yes

Eventually they will if allowed to. How horrid must his wife be that Clarence ALSO wants to end "mixed" marriage! (Just get a divorce, Crooked Clarence: don't make the REST of us suffer for your terrible decision years ago!)

They already ruled on that one. It is law for now. I know there was talk, but it's not really important. That case should have been thrown out. She has to follow the current laws. She was in the wrong. She has to issue the license. If she can't do so, she has to resign. She has no case.
