My article Legal Deserts Over Time was recently published in vol. 78 of the Maine L. Rev. In short, once a county becomes a legal desert, it is likely to remain a legal desert. It was a pleasure to work with the team & keynote their Rural Law Conf. digitalcommons.mainelaw.maine.edu/mlr/vol78/is...

"The way most students (future policy makers) learn about L&E is through its textbooks, and these textbooks continue to present Kaldor-Hicks efficiency as the goal of public policy. This presentation is not defensible on economic theory grounds because it is contradicted by modern welfare economics"

LPE Blog@lpeblog.bsky.social

According to a recent defense of law and economics, contemporary practitioners have abandoned the idea that law should maximize economic efficiency. To put this claim to the test, Darren Bush, Mark Glick, and Gabriel Lozada reviewed twelve major law and economics textbooks.

NEW: Remember when John Oliver opened a church to expose how easy it was to get tax exemptions? This year, ProPublica reporters set out to establish private schools to test if, truly, anyone could open one. We founded two. Here’s how.

propublica.orgHow ProPublica Reporters Became Private School Owners in 24 HoursThe reporting experiment demonstrates how easy it can be to open private schools that might then access public money. No credentials or background checks required.

The SEC filing its federal suit at the close of my subject matter jurisdiction unit is a wonderfully random happenstance. Lots to discuss in Civil Procedure on Monday.

A good use of eminent domain appears?

A proposed $12 billion hyperscale data center in Northeastern Kentucky could threaten a critical component of a nearby city’s drinking-water system, prompting officials to consider seizing part of the development site through eminent domain to protect the vital access to the Ohio River.

I cover this topic in my Children & the Law course. Based on my experience representing children as a guardian ad litem, fundamentalist beliefs are too often invoked to excuse abusive parenting—even outside places like Idaho that codify religious exceptions to child neglect & abuse law.

This thoughtful commentary is worth a read. I particularly liked: “Good stewardship means maximizing federal dollars, examining other appropriate funding sources and using community partnerships where they make sense. But sometimes, after doing all of that, we have to write the check.”

We may reasonably disagree on the ABA’s accreditation policies. However, the administration’s move reduces the independence of the judiciary and legal profession. State bars and judiciaries are self-regulating, in part, to insulate from partisan political influence.

My city experienced a tragic shooting over the weekend. A tragedy that may have been avoided with sensible gun control. The alleged shooter was born in 2008, the same year SCOTUS ignored the plain text of the 2nd Amend. to create an individual right to gun ownership for the first time. (DC v Heller)

More empirical evidence in support of policies that promote local ownership—not absentee landlords. I especially liked this finding, which matched my experience negotiating eviction settlements in rural communities:

Rural Reconciliation Project@rural-reconcile.bsky.social

Our latest digest examines CJ Ryan's findings based on more than 200,000 Kentucky eviction cases. His work considers how costs shape the use of formal eviction and reveals differences between small and large landlords, and rural and urban ones.

“[S]mall-scale landlords are more likely than large-scale landlords to settle eviction matters before reaching a final eviction judgment… For these landlords, the potential reputational harms and relationship damage from a final eviction judgment weighed heavily.”

I’m excited to dig into this further, but the key takeaways—combined with Emily Zacklin’s book “Looking for Rights in All the Wrong Places—recognize that state courts, not federal, are the next frontier for the Welfare Rights Movement.

From the abstract: “The resulting picture challenges two scholarly understandings: the federal courts as the premier fora for civil rights, and state courts as mere sites of routinized dispute processing… The welfare rights tradition need not end, but it must find a new home.”
