Any elected Democrat at the national level who does not have a plan to reform and neutralize the MAGA, partisan Supreme Court is not a serious person and should be laughed out of their primary.

The fact that the president's doctors are giving him the dementia test over and over again -- tracking his decline, most likely -- and that the president keeps bragging about having to take that test should be a five-alarm fire.

Looking forward to the Chief Justice of the United States once again saying and doing absolutely nothing about the President once again going after an individual federal judge for applying the law when the President deliberately breaks it.

I respect Steve, but the assumption in #4 is just so wrong. Please tell me what other reform will cleanly and immediately allow us to overturn the MAGA majority’s Rucho, Citizens United, Shelby Co, and other democracy-threatening decisions and allow Congress to fix our constitutional republic? 1/2

Calls for expanding #SCOTUS are entirely (and increasingly) understandable. But as today's "One First" explains, there are at least four difficult questions that those who support expansion should have to answer—especially as compared to other possible reforms: www.stevevladeck.com/p/bonus-257-...

What are these magical “alternative” solutions that he is referencing? Some may fix the Court in 20 years or longer - but none would do it NOW, when we actually, desperately fucking need it. And it’s so infuriatingly law professory to just ignore the immediate threat and act like this is theory. 2/2

We can’t lawyer our way around a SCOTUS majority that wields power in bad faith to aggrandize their own power and their own faction. Power in America does not work the way it used to. Fascism has come and it’s not going away. We do not have the luxury of responding with patient incrementalism.

The deployment of the National Guard in DC is illegal. We are back in court this morning arguing against the continued presence of thousands of armed troops in our city. We're staying in this fight because the US military should not be policing American citizens anywhere in America — including DC.

It is my sincere hope that Musk is found personally liable for such significant damages here that Ms. Comans never has to work another day in her life if she so chooses.

Aaron Reichlin-Melnick@reichlinmelnick.bsky.social

This fraud was then perpetuated by Elon Musk himself, who was running DOGE at the time, and who retweeted a post about the incident while declaring it a "criminal act." The government now "concedes ... that Mr. Musk and officials at FEMA and DHS knew this information was false."

This is a significant worsening of our current state of constitutional collapse. I know it feels like there are so many, and there are, but in terms of crossing the Rubicon moments this one's up there.

If in the next three years we don’t substantially reform the Court and throw Alito’s entire jurisprudence in the trash (and I mean all of it)… we will have allowed this rightwing politician to have made the US substantially more fascist, against the popular will.

Samuel Alito: We won't overturn Obergefell because it's engendered reliance interests. Jan Crawford: Well, many people had organized their lives around Roe v. Wade. Alito: No, they didn't. Women merely had an "abstract" interest in "ideas about the kind of society that they were going to live in."

Yes, you can. Because the case is obviously crazy and should be 9-0. Only now you have to add that at least 4 members of the court are also 'crazy' in that they are pursuing an activist agenda rather than interpreting the law.

Yes, Congress should be able to do these things. A court this contemptuous of Congress deserves to be packed by Congress, not only to correct these disastrous precedents but also because Congress needs to show both Article II and Article III who’s boss.

Big surprise. SCOTUS says Trump can fire anyone from independent agencies, except the Fed. For some reason, ungrounded in the Constitution, the federal reserve is unique. (The reason is that the Justices have financial investments and value them.) Couldn't be more nakedly political.
