This is not about the merits of Iran’s nuclear program. No president has the authority to bomb another country that does not pose an imminent threat to the US without the approval of Congress. This is an unambiguous impeachable offense.

A lot of people are talking about whether Trump is going to go to war with Iran but not enough people are talking about the fact that Trump has no legal authority to do so without Congressional authorization

Horrific act of terrorism in Minnesota today. Two Democratic lawmakers were targeted for violence for no reason but their political affiliation. We will be thinking of the victims today. May the terrorist who committed these unspeakable acts be swiftly brought to justice.

I said my main goal of this trip was to meet with Kilmar. Tonight I had that chance. I have called his wife, Jennifer, to pass along his message of love. I look forward to providing a full update upon my return.

And yet, as I note in the piece: "All of this, however, is just an argument seeking to manipulate the law. It is not the law and it is not a court’s ruling." This is what they want. If the administration does not back down, the courts, Congress, or the people must ensure the plan fails.

lawdork.comTrump told us the horrifying reason why Kilmar Abrego Garcia is not back in the U.S.The Trump administration wants to send Americans to foreign prisons. Keeping Abrego Garcia in El Salvador is key to that lawless plan.

If the U.S. government is going to take the position that, once removed from the United States, folks can’t be brought back, then it sure seems to me that federal courts should be reflexively and categorically barring *all* removals until they’re 100 percent certain that the removals are lawful.

The justices were unanimous that the Trump administration can't designate people as enemies and hustle them off in the dead of night without access to the courts. The majority says the government must provide people enough notice that they can "actually seek habeas relief in the proper venue."

BREAKING: The Supreme Court, on a 5-4 vote, ends the TROs in the Alien Enemies Act litigation, holding challenges must be brought in habeas and in the jurisdiction in which detainees are held. The court also holds that notice and an actual opportunity to bring a habeas case must be given.

How many Signal chats with sensitive information about military operations are ongoing within the Pentagon right now? Where else are war plans being shared with such abject disregard for our national security? We need answers. Right now.

I just want to highlight this comment from Boasberg out of the AEA case hearing —>

Chris Geidner@chrisgeidner.bsky.social

Boasberg responds to him: "I will get to the bottom of whether they violated my order, who ordered this, and what the consequences will be." He then asks Ensign, who only says that he understands everyone had final orders of removal.

A federal court’s jurisdiction does *not* stop at the water’s edge. The question is whether the *defendants* are subject to the court order, not *where* the conduct being challenged takes place. Were it otherwise, the government could act lawlessly overseas and courts would be powerless to stop it.

THIS FIGHT IS NOT OVER. TOMORROW MORNING: everyone MUST call en masse. Do you have a recurring donation to your Democratic Senator? PULL IT IF THEY ARE VOTING YES. We can still fight back!!

🚨 Everyone needs to call their Dem Senator right now. They are starting to cave. Tell them: 1. Vote NO on Cloture AND 2. Vote NO on the Republican spending bill. Don’t let them pivot to reconciliation. GOP doesn’t need Dem votes on that and they know it. TODAY is the showdown. 🤳🏽: (202) 224-3121

The Appointments Clause lawsuit folks have to be thrilled to see Elon in a Cabinet meeting alongside all of these Presidentially appointed and Senate confirmed agency heads. Their case is looking really quite compelling.

This is why you fight these cowards. The moment you stand up to them, they crumble. Homan has nothing. The Fourth Amendment is clear and I am well within my duties to educate people of their rights. He can threaten me with jail and call names all he wants. He’s got nothing else.

Tonight Donald Trump fired dozens of prosecutors at the DC U.S. Attorney's office and agents at the FBI. Another Friday Night Massacre, as the President removes those loyal to the constitution. And installs those loyal to him.

Yes, this administration is dangerous and cruel, but they are also shockingly dim and incompetent. Opportunities are everywhere. Make everything as hard as possible. Resist every demand. Refuse entry without a warrant. Don’t take the buyout. Their problem solving skills are 📉

The freezing of federal grants, the firing of all inspector generals, the immunization of political violence - does everybody not see what’s happening? In a blitzkrieg, Trump is trying to collapse our democracy - and probably our economy - and seize control. Call it what it is.

NEW: My staff has confirmed reports that Medicaid portals are down in all 50 states following last night's federal funding freeze. This is a blatant attempt to rip away health care from millions of Americans overnight and will get people killed.

Dear Internet: #SCOTUS holding that the President can't be prosecuted for official acts does *not* mean, under *any* non-frivolous reading, that the *federal government,* including all of its officers, is immune from civil suits for *its* official acts. There's just no equivalency between the two.

Jon Kessler reposted

There is simply no plausible argument that the president has the constitutional authority to refuse to spend appropriated funds because he doesn’t like how the money is being spent. The legality of policy impoundments is just not a close question.

You are up to date.
