I accidentally wrote a thread summarizing Columbia law professor @michaelgerrard.bsky.social's new article on the draft federal permitting bill. Nine specific ways BAAJA would make it easier to build fossil fuel infrastructure.

Kevin J. Kircher@kevinjkircher.com

I appreciated the replies from @janhasselman.bsky.social, an environmental litigator who has blocked fossil projects using tools that BAAJA would take off the table. I also encourage you to read this New York Law Journal article by @michaelgerrard.bsky.social, a law professor at Columbia.

pet peeve of mine that you see in all sorts of contexts: posing questions that "need to be answered" that have been answered many times. this just mires the debate in an endless loop where one side has to argue and the other just asks the same questions over and over.

Steve Vladeck@stevevladeck.bsky.social

Calls for expanding #SCOTUS are entirely (and increasingly) understandable. But as today's "One First" explains, there are at least four difficult questions that those who support expansion should have to answer—especially as compared to other possible reforms: www.stevevladeck.com/p/bonus-257-...

I was wondering what the latest numbers would look like, as I think a lot of us have seen interconnection queue results from the last decade or so that are dominated by renewables — but Kevin shows that MISO's queue is now dominated by gas.

Kevin J. Kircher@kevinjkircher.com

I wrote about how BAAJA, the federal permitting bill, might impact the buildout of power plants. I looked at the midwest transmission grid operator's updated interconnection queue, which MISO overhauled in 2024, as a leading indicator of what people are trying to build. TL;DR: It's mostly gas.

Let's not forget, folks: American Petroleum Institute CEO Mike Sommers told House Republicans that "This is literally what we've been asking for for over a decade, and it is a generational opportunity to get permitting reform done."

I've been racking my brain on this, and the only answer I've been able to come up with is "permitting reform is best negotiated when environmental-justice and -protection advocates have more limited leverage." I'm very open to alternate explanations!

Given that so many of the very special energy wonk folks over on X have declared that the Permitting Deal is absolutely fucking awesome, I'm really looking forward to reading panicked fossil industry press releases!

This from 2024 on permitting reform—the underlying theory of change, role of emissions modeling, & broad array of values beyond energy infrastructure that are affected—very much holds up. Give it a read to get up to speed & understand the background of what'll prove a hotly contested fight.

NEW CPE REPORT on the urgency of building an interregional transmission macrogrid! @cthelala.bsky.social and I argue that only the federal government can get it built; no other actor on the grid is capable of doing so! Really, this is a paper about the theory of transmission as an asset class:
