Am I reading this correctly? The question at issue is damages? Compensatory damages? Is the $ for documented out of pocket expenses that should have been covered by school or simply to make a point?? I support the former. Big problem if the latter.

Legal fees, travel costs, medical care costs incurred by the need to travel, emotional damages and compensation for educational time lost are all possibilities for why the parents are asking for damages.

I’m assuming legal fees would be paid. The ability to recover costs of litigation would open up the possibility for other parties to pursue lawsuits for their rights, which is a key barrier now because of the standard this case challenges.

I give it less than a month before RFK shifts his eugenics sights on the disabled. I'm not sure that legal victories matter when Mengele is still allowed to be in charge.

this reminds me of when I was headed to high school, the one I wanted to go to was small enough for me to be able to walk w/o much trouble but entry was lottery-based and I didn't get in. the other HS had a massive campus and I remember one of their counselors telling my parents I could not attend-

Not to mention private schools that manage certain kinds of disabilities usually have one or two in the entire state and cost about $30,000 + or more for elementary school and if your child needs to have physical support add a personal care assistant (PCA) expense.

IDEA doesn’t allow for waiting lists for evaluation. There are mandated timelines for assessment. A diagnosis is medical; it’s not required for educational services and accommodations.

US has two systems: early intervention (state agency - birth to 3rd bday) and education (schools - 3+ yrs). Typically depends on severity when kids get dx. IDEA (federal special ed law) doesn’t allow waiting lists.

As a public school teacher, I can tell you that I do provide accommodations and differentiation to my students, regardless of needs. That said, without documentation, I don't know if little Sarah is being defiant because she hates English class or because she has something else going on.

I didn’t say they created the case. I said they created this mess. SCOTUS gave Trump immunity. Trump is against everything n SCOTUS has a tendency to give in. The case is based on disability. Something Trump is dead against for some reason. So SCOTUS do your job n protect those kids.

All the events in this case happened years ago in Minnesota, where Trump has little influence. Even if Trump was "against everything" as you claimed, that would make no difference in how the school district paid -- or didn't pay -- the money. Not everything is about Trump.

If they rule in favor of schools it means that kids with any disability could be denied protections or accommodations so that they have an equitable chance at learning. This could decide if ALL kids have the right to an education, or if only able-bodied ones do.

Exactly why I’m concerned I don’t have kids I’m childfree but I do have adhd I was diagnosed at 9 with inattentive type I was in Special education classes and had an iep with access to notes and extra time on tests. Kids with disabilities deserve reasonable accommodations to succeed and learn

Ugh I read the article and noticed that the school is in the Osseo area school district in MN. I had an apartment there for a bit. Osseo is an old farming town, the lands around it having slowly been sold off and made into Maple Grove and Brooklyn Park.

Now I think it's important to note that there is a HUGE income disparity between the residents of Maple Grove and Brooklyn Park. Brooklyn Park is a BIPOC community with diverse immigrant neighborhoods. Maple Grove is mostly wealthy white people. Brian Thompson, the insurance CEO, lived there.

The ‘better choice’ will 9 times out of 10 be the public schools unless a disability is super severe. No one’s sending their kid with an IEP to the local Catholic School, but school choice advocates would have you believe that everyone wants out of traditional public schools.

Super severe or relatively mild. I would have needed an IEP in a public school, and likely wouldn’t have gotten one (autism wasn’t diagnosed in girls who could talk in those days), but did well in a smaller, less chaotic private school classroom with informal supports.

Importantly, though, that was a secular private school, not a Catholic school, and school vouchers wouldn’t have been nearly enough to cover it. And had I been able to thrive in a public school setting, and get a comparable education there, that would still have been better.

Even if you don't have one scintilla of humanity, you would want to invest in supporting children with various challenges to help them develop the skills necessary to become independent and contributing members of society. Efficiency requires investment and every child matters financially! Dumb!

Should it need to be any more sophisticated than a doctor filling out a form? I think if they have a doctor filling out the form saying that the child needs particular assistance, they should get that particular assistance. It shouldn't be more elaborate than that.

Let's settle this right now: Alito and Thomas (and maybe the other cons) will find that Federal law grants no inherent constitutional right for people in need to be helped by the government. (sigh) Okay, what else ya got?

“Persons with disabilities are fully human subjects, with rights and duties” and every human being has the right to live with dignity and to develop integrally. Unless this basic principle is upheld, there will be no future either for fraternity or for the survival of humanity”. Pope Francis.

I didn’t have to prove anything. The school said they would evaluate my son by putting him in regular a kindergarten class. Within a few days, I had an IEP meeting and he was receiving services and still is.

Have lawmakers sit in one of those classes all day at a public school and then leave and say they need less money. If they do visit across all 50 states, teachers would be getting salary increases and not only in special needs classes, just saying!

Public schools can’t or don’t fund these programs and services. I work in this field, I have an entire building, an official and unofficial caseload. I don’t even have time to use the bathroom most day.

I find the intro by NPR to be misleading. After reading the article, it appears the family did prevail and their daughter is receiving the services they deemed necessary. The family now wants Compensatory Damages, and that is the case before the Supreme Court.

Two of the most dangerous people in America Pam Bondi of Project 2025, Trumps Attorney General Steve Miller of Project 2025, Trumps top advisor Arrogant, empowered and focused on fascism Not afraid to hurt anyone who stands in their way.

It’s weird, surely there’d be more than one kid who’d be helped by an alternative timetable? While others might not need it, you’d think there would’ve been enough interest amongst a district for a small class, reducing extra help hours during the morning across a district, which could fund this.

Accommodations need to be thoughtful, and having a diverse workforce helps come up with better ideas for meeting these without being onerous. Sounds like this district needs some education…

The child in this case requires a 1-2 adults: 1 child ratio. Of course it’s a battle. I feel for the parents and hope they get respite. But this doesn’t create the expert professionals required to get a profoundly disabled teen presenting as an 18 month old a meaningful improvement in learning.

Because it isn’t funded. Who is doing the work? There’s a shortage of speech/language paths, there aren’t enough paras able/willing to work for crap pay, and the states & feds like to take away funding for special ed.

Money is the issue, but a startling number of special ed teachers are useless for anything but the most straightforward issues. For 8 years my district tried to declare my learning-disabled son autistic, which would have made him worse. That's all they understand because that's where the money is.

Most [insert position type here] are useless for anything but the most straightforward issues… This statement works for mechanics, plumbers, accountants, doctors, cashiers, lawyers, etc. - and special ed is no exception.

My son’s medical condition was initially diagnosed as eczema. Actually, his leg wasn’t growing. People make mistakes, even “experts”, even experts with 8 years of college/med school and a residency. paras who excel with kids with Down’s may need terrible with a kid with emotional disabilities.

HERE IS A GREAT CHANCE FOR THE SUPREME COURT TO SHOW THEIR HUMANITY !! EVERYONE WHO CARES ABOUT KIDS & THE DISABLED SHOULD KNOW ABOUT & FOLLOW THIS CASE & IT'S PROGRESS !! BY DOING SO, KEEP THE SUPREME COURT HONORABLE !!!!

WHY IS IT EVER IN QUESTION!!! to do anything less than give full support to those who are challenged physically, or mentally is archaic and goes against everything that IS JESUS!! we teach our children, to be good and allowing the criminals to continue destroying our nation should be a crime itself

At one time our education professionals were able to make these types of determinations, but now they have been handcuffed by the right and their anti-woke sentiment and they no longer are able to. WOKE=DECENCY, ANTI-WOKE = INDECENT.

The state’s Dept of Ed enforces compliance with state ed code and federal ed laws. Parents can file complaint that a district is out of compliance or file a due process complaint for an administrative hearing. If not satisfied by outcome, parents can appeal in federal court.

reuters.comTrump administration ordered to retract 'sham' rationale for firing workersA U.S. judge has ordered the Trump administration to put in writing that thousands of federal workers were not fired over their performance as agencies had claimed in terminating them en masse.

If this administration is against children w/disabilities in schools, then they are also against The Special Olympics. Remember Trump tried to end Special Olympics in first term. Shame on anyone who is against DEI!

I am one of those parents who fought with everything I had to get my child with disabilities the services he needs. Instead, he got mocked by a "para" by mimicking my child's Tourette's. And the school kept this person.

My daughter was in preschool for 3 years and in that time learned 3 letters. She could count to 10 only. They said she didn’t need any special help. We got a private neuropsych and she has several diagnoses and an iq of 73. We pulled her out to homeschool but yeah this is a huge, systemic issue.

Our system is pretty broken. It has been for awhile due to greed, underfunding and tying school funds to property taxes. If we were a Christian nation we would help the least of these... but those who claim Christ dont follow his word. We need to very seriously think about ending corporate welfare

Your description is misleading. The write up says the appeal is about compensating damages, not whether the young lady should get the services. That has already been settled. This is about punishing the school system for not providing the services initially.

Yes…the results could be crippling for the district. The funding system in education is severely broken and needs to be addressed…and fixed! Our students all deserve more, but our highest needs students are usually the ones who suffer most!

It can be crippling. Sometimes districts will spend more on lawyers than the service provided to child would have cost. A school district went bankrupt on legal fees bc they preferred to fight instead on providing services to the student.

If they’re going to fight servicing students harder than they fight for the student, part of me feels like they SHOULD be crippled. And I say that as a SPED teacher who is constantly at odds with my district because I fight hard for what my kids need.

AMERICANSWhile Congress and senate lawmakers are engaged in political Kabuki theater, Trump, Bondi, & Hegseth directed by Stephen Miller have been preparing a coup d’etat before midterm election to consolidate the power of a Nazi/Soviet style imperial presidency giveth by Supreme in-Justice Roberts!

Spoiler alert. They need to be rich. Anyone else? Well, they were compiling a list of all people with autism, privacy and other laws don't matter. I doubt they were doing it to provide extra assistance. I fear the rightful outcry just pushed their schedule back.

It took more than 45 years to get my, life long, health problems acknowledged. School was hell because of these issues and I was ignored and told to shut up the entire time. Parents needn't prove a darn thing. Educators, legislators and employers need to start listening. Fast.

My niece went through a hard time until college. Early school said nope, no issues. Just lazy/distracted. Finally in college, diagnosed with adhd, got meds, and is thriving. So much unnecessary suffering

I never had to provec anything. Fairfax County, VA brought their concerns to my attention, tested my child and then provided appropriate teaching services. He is a college graduate, a medical professional and has had employment in his field since his graduation. Governments do work for us.

If Ava has an IEP that includes a schedule of services stating how much time she is supposed to get each day and that school district accepted the transfer documentation, they are liable to give compensatory services to that student according to the time she missed.

I am not opposed to this as there is rampant abuse by humans who want something for nothing, exponentially all the anchor babies being stuffed into the American olive, redneck cousin baby-makers,the I-gotta-make-a-baby-yo-prove-I-am-a-man human: yes,I am NOT opposed to proving the FACTS; fairness
