(all of this would be news to the authors of the 14th amendment btw but then originalism is a tendency designed to reify hierarchies of status and thus they dispense with it when it comes to equal protection jurisprudence)

i have said this before but “It is not permissible under the 14th Amendment for the state to alleviate racial inequality” is basically a version of Plessy v. Ferguson, which held that the 14th Amendment was not meant to equalize social relations. bsky.app/profile/mike...

If and when the Roberts Court declares race-neutral admissions policies unconstitutional, expect the majority decision to cite...RBG's solo dissent from Fisher I saying race-neutral policies were really race-conscious ones. She meant that approvingly. The Roberts supermajority...won't.

the other thing is that conservatives resolutely do not see the purpose of education as providing social mobility but as reifying and deepening existing inequalities of status. they are as hostile to low income students getting admission to elite institutions as they are black ones.

Oof. SCOTUS has to punt on reviewing a major copyright decision from the Fifth Circuit because too many justices recused themselves.

Reyes gonna reyes even harder now

MeidasTouch@meidastouch.com

Trump launches an early morning tirade against federal Judge Reyes, calling her a “crazed lunatic” and says she may be “insane.” This comes after Reyes demanded answers from Trump’s DOJ over its contradictory claims re his D.C. golf course project. Trump now declares work will begin “IMMEDIATELY.”

This is a big deal. DC fed judge says that DOJ's pursuit (and use) of the state voter files is unlawful, on a bunch of different grounds. And effectively confirms that for the 18 states that submitted files willingly, whoever collected the files at DOJ Civil Rights committed federal crimes.

I am so curious to see how the Albemarle County school facility sales tax referendum goes. If it fails, it will be both a sign of how far mistrust has spread and a huge blow to the county school’s much needed capital improvements.

My takeaways from the SCOTUS Missouri ruling: 1. The Court is angry for the 8th Circuit and district court not following its earlier orders. The court says: “Given this Court’s two prior orders in this litigation, our conclusion that this was error should come as no surprise.”

Just to be as clear as possible, this is going to force the Supreme Court (or Justice Kavanaugh) to intervene *again.* But there’s every reason to think that the parties will seek that intervention (and #SCOTUS will provide it) fast enough to prevent this ruling from actually going into effect.

The Eighth Circuit has made some truly bizarre (and terrible) decisions in voting cases in recent years - denying any ability of private plaintiffs to enforce Section 2 of the Voting Rights Act, for instance — but this one takes the cake. Expect SCOTUS to overturn this swiftly.
