Pamela Dorn sued Prospect Medical in 2024 after her husband died while under its care. But because the now-bankrupt hospital chain never set aside money to self-insure malpractice claims, she may never have a chance to hold Prospect accountable. By @peterelkind.bsky.social

propublica.orgFor-Profit Hospital Chain Never Put Aside Money for Malpractice Insurance to Compensate Injured PatientsEager to save money, Prospect Medical promised to “self-insure” malpractice claims brought against its doctors and hospitals. The chain’s bankruptcy now threatens to leave hundreds of patients whose claims are pending with no recourse.

Heartbreaking story and shows what is wrong with private healthcare. I am sorry Americans cannot rely on a proper health care system that serves all equally and equally well. So much of the EU (and that does not include UK) and Canada do have such systems.

Doc here. Healthcare should never be for profit, aligned in any way with unregulated capitalism. Greedy lying lawyers don’t help. They take most of any settlement. Tell patients to sue whether or not there was actually malpractice. We could copy any truly evolved country and have great care for all!

So let me guess. PE came in and extracted all value out everything they could. The people running the corp knew they weren’t following the law and did what they did anyway, and somehow - somehow - a judge in the US can’t figure out how to reimburse this widow. Fuck capitalism.

so a department for consumer protectionism just doesnt exist in the US? Is it really just the worlds biggest playground for Moguls and enterpreneurs, where citizens are nothing more than lab rats? Holy fucking Christ, Hollywood really played us like a fiddle growing up. F that shithole

This is the problem! Any owner, CEO or shareholders of any corporation or LLC should absolutely have their assets on the line to be taken if any that company is involved in any illegality. All this shit would end.

How can a person with a car or house loan being insured is strictly regulated, but a hospital or any medical facility not having the proper insurance is like ahhh no big deal! WTAF

This exemplifies why more regulation of healthcare providers is required. Though a much better idea, would of course be, an end to for profit healthcare!

America is not the greatest nation on earth that it’s banged on about for years, terrible healthcare for working people, and the citizens elected a criminal as their president, who is the dumbest president in the world.

Of course she can. She can win in court and execute her judgment by taking as much of their property as she needs to fulfill what they owe her through a Sheriff's sale. I used to be a debt collections paralegal. Piece of cake.

Time for legislation allowing people to sue the private equity firm owners for this bullshit. We know exactly which assholes created this cesspool and they should be liable for the death and destruction they created

It's troubling to hear that a family's pursuit of justice might be hindered by a hospital's financial struggles, it's even more disturbing that the system allows institutions to risk leaving victims without recourse simply because they don't properly prepare for worst-case scenarios.

Stop making hospitals, CEO's, shareholders rich. Bring national healthcare to USA, bring back the Public Good (work for a more perfect union), not private good. USA is becoming a commodity. USA is turning into a private equity hedge fund for the oligarchs, buying/selling privatizing everything

The words “hospital” and “for profit” should never be in one sentence, unless that “never” is between them! But of course the neo-liberalism and free-market zealots are there to profit exactly from the human suffering.

And this is why we need to remove the absolute immunity for corporate boards of directors— a CEO and CFO made this decision and they walk away with their assets intact and no responsibility for their actions. We need to haul their assets and to court and give em a good asset whipping

For the wages of sin is death; but the gift of God is eternal life through Jesus Christ our Lord. - Romans 6:23 KJV

I’d say municipality and state have to bear the burden and pay up; they should’ve made sure the hospital had appropriate insurance. My state makes us insure cars & they do check. A lesson for municipal/state functions, a boon for a widow bereft a husband & his contribution to household/society

Excellent point, I had thought this was already done Wrap em all up, multiple failures from multiple angles The failure of all of these sectors with this widow is a failure to all of us, every one, as well as to themselves as we all rely (& pay into via tax/etc) on healthcare, systems & eachother

Hospital are pretty much self-regulated and monitored and that should change. Just like the blood industry change via a court order and was put under the and regulated by the FDA. What became of that situation was a safter and well-regulated blood supply for patients.
